Nations Unies A/HRC/37/G/3 Assemblée générale Distr. générale 8 mars 2018 Français Original : anglais A/HRC/37/G/3 2 GE.18-03600 Annex to the letter dated 26 February 2018 from the Permanent Representative of Azerbaijan to the United Nations Office at Geneva addressed to the President of the Human Rights Council Joint Statement by the Ministry of Foreign Affairs and the Prosecutor General’s Office of the Republic of Azerbaijan on the 26th anniversary of the Khojaly genocide The Republic of Armenia bears the responsibility for overtly supporting aggressive separatism and state sponsored terrorism in Nagorno-Karabakh region of Azerbaijan since late 1980s, unleashing the war and by use force occupying one fifth of Azerbaijan’s territories, carrying out ethnic cleansing of more than million Azerbaijanis in Armenia and in the seized lands of Azerbaijan and committing numerous war crimes, crimes against humanity, and acts of genocide. (...) With the support of corrupt foreign politicians and lobby groups Armenia is engaged in active disinformation and fake news campaign to propagate the illegal puppet regime established in occupied lands of Azerbaijan, which is nothing other than result of military aggression, occupation and notorious ethnic cleansing. Alongside the Republic of Armenia’s responsibility as a State for internationally wrongful acts, under the customary and treaty norms of international criminal law, certain acts perpetrated in the context of an armed conflict, including those in the town of Khojaly, are viewed as international criminal offences and responsibility for them is borne on an individual basis by those who participated in the said acts, their accomplices and accessories. (...) It is incontrovertible today that no official or political status cloaks the person concerned with immunity for the most serious international crimes, such as war crimes, crimes against humanity, genocide and ethnic cleansing. The Republic of Azerbaijan is confident that the consistent measures being taken at the national level, as well as the existing international legal framework, will serve to bring to justice those responsible for the grave offences committed against the civilian population of Azerbaijan during the conflict.

The atrocities of Sumgait instigated the ethnic cleansing and massacres of Armenians in other cities of Azerbaijan, such as Baku and Gandzak. (...) During the 44-day war, the Azerbaijani armed forces, driven by a sense of impunity, committed numerous violations of international humanitarian and human rights law, which are manifestations of mass atrocities, including ethnic cleansing and war crimes. While adhering to the behaviour of terrorist groups, the Azerbaijani armed forces committed violations against prisoners of war, civilians, barbarically destroyed historical-cultural monuments and desecrated sanctuaries.

The Azerbaijani authorities considered the operation ‘Koltso’ as the beginning of the complete cleansing of Artsakh from the Armenian population. It became another manifestation of the policy of ethnic cleansing conducted by Azerbaijan in 1988-1991 in Sumgait, Baku and other settlements of the Azerbaijani SSR, as well as in the villages of Northern Artsakh.

As a result of the occupation, Shusha city and 30 villages of Shusha district were destroyed, 195 innocent civilians were killed, 165 were wounded and 58 persons went missing, more than 24.000 inhabitants of Shusha were subjected to ethnic cleansing. The tangible cultural and spiritual heritage of the Azerbaijani people has been severely damaged as a result of the occupation of Shusha, a city of exceptional historical, cultural, spiritual and symbolic significance for the people of Azerbaijan and known as “Cradle of the Azerbaijani music”, “Conservatory of the Orient”. (...) The aggressor state Armenia, following the ethnic cleansing conducted in course of Shusha’s occupation, in contradiction to the requirements of international humanitarian law, destroys the historical and cultural heritage of Azerbaijan and gradually changes the cultural image of the city.

We strongly condemn Armenia’s purposeful and on-going policy based on genocide, a crime against humanity, racial discrimination and ethnic cleansing against the Azerbaijani people, and declare that, in order to achieve peace and reconciliation in the context of resolving the Armenia-Azerbaijan conflict, it is extremely important to put an end to impunity for all war crimes and crimes against humanity, including acts of ethnic cleansing and genocide perpetrated during the Armenian military aggression against the Republic of Azerbaijan, and to restore justice to the victims of those crimes.

Against the background of continuing military occupation and ethnic cleansing of the territories of Azerbaijan by Armenia, the holding of “elections” in the occupied territories of the Republic of Azerbaijan constitutes a clear violation of the Constitution of the Republic of Azerbaijan and the norms and principles of international law, including the UN Charter, CSCE Helsinki Final Act of 1975 and the related UN Security Council Resolutions and, therefore, shall have no legal effect whatsoever. The illegal regime established by the Republic of Armenia in the occupied territories of Azerbaijan is ultimately nothing other than the product of aggression, ethnic cleansing and racial discrimination: It is under Armenia’s direction and control.
