As it is well-known, almost 20 per cent of the internationally recognized
territories of the Republic of Azerbaijan, including its Nagorno Karabakh region and seven
adjacent districts still remain under illegal occupation of the armed forces of the Republic
of Armenia, which conducted total ethnic cleansing against the original Azerbaijani
population. (...) In that regard, it should be reminded that the Republic of Armenia bears the primary
responsibility for unleashing the war against the Republic of Azerbaijan, occupying its
territories, committing the most serious crimes of concern to the international community
during the conflict, carrying out an ethnic cleansing on a massive scale and establishing the
ethnically constructed subordinate separatist entity on the occupied territories of
Azerbaijan.

As a result, about one-fifth of the territory of the Republic of Azerbaijan has
been occupied; more than one million Azerbaijanis have been subjected to ethnic cleansing
in occupied lands and Armenia itself. During this aggression, numerous military offenses,
crimes against humanity and genocide were committed against the civilian population of
Azerbaijan and the Republic of Armenia as the aggressor bears the responsibility for them.
(...) It is incontrovertible today that no official or political status cloaks the person
concerned with immunity for the most serious international crimes, such as war crimes,
crimes against humanity, genocide and ethnic cleansing.
Alongside the ongoing prosecution of persons charged with committing various
crimes against their own people in Armenia, the trial over the crimes committed by them
against the Azerbaijani people is also crucial for the establishment of international justice
and can contribute to the settlement of the Armenia-Azerbaijan conflict by peaceful means.

The Commissioner recommended to include the discrimination, xenophobia, ethnic

and to join efforts for punishment of the States charged in crimes with severe violation of
human rights at the international level.

one million people were forced to leave their homes, became refugees and internally
displaced persons, thousands of compatriots became victims of genocide acts, mass
annihilation and ethnic cleansing, civil population, children, young people, persons with
disabilities, women, elderly persons went missing, were taken captive and hostage,
thousands of living, education, healthcare and other social objects, as well as historical –
cultural monuments were destroyed.

Armenia unleashed the war, used force against Azerbaijan and
occupied its territories, including the Nagorno-Karabakh region and seven adjacent

Azerbaijanis from their places of origin, committed other serious crimes during the conflict
and established the ethnically constructed subordinate separatist entity on the occupied
Azerbaijani territory.
2. (...) In its resolution 1416
(2005) of 25 January 2005, the Parliamentary Assembly of the Council of Europe, of which
both Armenia and Azerbaijan are members, noted particularly that large-scale ethnic
expulsion of the Azerbaijani civilian population and the creation of mono-ethnic areas
resemble the terrible concept of ethnic cleansing. The European Court of Human Rights
later arrived at an important conclusion qualifying the offences of the invading Armenian
troops against Azerbaijani civilians as acts of particular gravity that amount to war crimes
or crimes against humanity2.
(...) The obligations under such
norms arise from those substantive rules of conduct that prohibit what has come to be seen
as intolerable because of the threat it presents to the survival of States and their peoples and
the most basic human values.11 Among these prohibitions, it is generally agreed that the
prohibitions of aggression, genocide, crimes against humanity, ethnic cleansing, racial
discrimination, torture and slavery are to be regarded as peremptory.12 There can be no

Additionally, the blockade imposed on Armenia by Azerbaijan and Turkey since
early 1990s as a result of the drive of the people of Nagorno Karabakh to exercise
peacefully its right to self-determination and the military attempts by Azerbaijan to stifle it
at any cost by ethnically cleansing these territories from its rightful owners, has impacted
the full enjoyment of the economic, social, cultural and religious rights in the Republic of
Armenia.
9. (...) It should be noted that the Azerbaijani attempts to give a new nature to the Nagorno
Karabakh conflict by depicting it as a conflict between Armenia and Azerbaijan goes in line
with its policy of revision of history, roots and causes of the conflict, its aggression against
Nagorno Karabakh and Armenia and the full-scale war unleashed in 1992 with the only
purpose of cleansing the Armenian population of Nagorno Karabakh from its ancestral
home. (...) Azerbaijan forgets the extensive efforts exerted aimed at ethnically cleansing the whole
territory of its Armenian population as an answer to the Nagorno Karabakh people’s
peaceful call for self-determination, and the war of aggression unleashed that has resulted
in the loss of thousands of lives and hundred thousands of people becoming refugees and
internally displaced people from both sides.

Guliyev, who were taken hostage by Armenia and subjected to torture and other degrading
treatment. (...) Such a position aims at legitimizing
the results of the ethnic cleansing, and openly contradicts the philosophy of international
human rights law that all human rights are universal, indivisible, interrelated and
interdependent and no one can claim for an individual or collective right at the expense of
rights and freedoms of others.

cleansing of about 1 million indigenous Azerbaijanis from their homes in both Armenia and
the occupied territories of Azerbaijan and the extensive destruction and pillaging of the
seized areas.
(...) Armenian ideologists
and their supporters in the high political leadership of the USSR, understanding the
illegality of the separation of Nagorno-Karabakh from Azerbaijan based on the Soviet
Constitution, resorted to such provocation with the aim of justifying the idea of
impossibility of further coexistence of Armenians together with Azerbaijanis, providing the
complete ethnic cleansing of the Azerbaijani population in Armenia and discrediting
Azerbaijan.
