4.3 CONTRACT STRUCTURES AND FISCAL REGIME DESIGN
There are many different legal frameworks which govern the relationship between the host state/resource owner and the contractor tasked with developing the natural resource. (...) By taxing the profits from extraction, there is the natural consequence that a tax

According to article 13 of the Law on Ecological Expertiza (Law on Expertiza),
performance of an expertiza was obligatory for environmentally hazardous activities.
Extraction of minerals, including natural gas, regardless of the amount of extraction or the
technology, was included in the List of Environmentally Hazardous Activities approved by
Decree No. 808 of the Cabinet of Ministers on 28 August 2013.12
27. (...) The communicant claims that the Yuzivska and Oleska projects fall under paragraph
20 of annex I to the Convention because the extraction of minerals, including natural gas,
regardless of the amount of extraction or technology, is required to undergo a mandatory
expertiza, including public participation in accordance with domestic legislation. (...) Furthermore, a PSA concerning the extraction of mineral
resources is clearly a measure “affecting or likely to affect the state of elements of the
environment” such as “soil, land, landscape and natural sites” for the purposes of article 2 (3).

GENEVA (8 July 2019) – Industry’s extraction of natural resources routinely inflicts acute human rights violations on racial and ethnic minorities, indigenous peoples and other marginalised groups, said the UN’s human rights expert on racism.
