ISSUES RELATING TO DOCUMENTATION OF CIVIL STATUS AND CITIZENSHIP 51. Issues of documentation, regularization of legal status and denial or deprivation of citizenship emerged as major concerns for residents of Haitian heritage. These problems impact both long-term settled resident Haitians and Dominican citizens of Haitian descent. (...) In addressing the question of the legal status of long-term undocumented workers and the nationality of children born to Haitian parents in the Dominican Republic, the Inter-American Commission on Human Rights noted that while many countries grant citizenship or permanent resident status after lengthy periods of residency, this is not the case for Haitians in the Dominican Republic.

In particular, as legal immigration routes are limited due to the implementation of new employment schemes, international marriages are becoming more popular than ever because it guarantees a long term and stable resident status. The number of marriages between Korean men and their foreign female spouses stands at around 30,000 in 2006, more than three times higher than marriages between Korean women and foreign male spouses. (...) In accordance with Article 333 of the Amended Guidelines on the Resident Status of Foreign National Spouse married with Korean Nationals (1 October 1999), foreign spouses married to Korean nationals - whether male or female - shall obtain approval regarding the resident status. 40. Another disturbing factor in these marriages lies with the fact that the legal resident status of a female migrant spouse depends entirely on her Korean husband and this subjects them to all sorts of domestic abuse. 46.

Law No. 6 (1986)12 approves the statute of the resident foreign worker. The law applies to foreign workers resident in Angola and hired there. (...) Presidential Decree No. 5/95 (1995)14 focuses on the employment of non-resident foreign workers. Its purpose is to regulate the employment of the non-resident foreign labour force as well as the qualified national labour force working for foreign companies and other employing entities that perform their activities in the territory of Angola.

Shortly before the independent expert’s mission, a long-time resident Haitian family brought a case before a court of first instance, which upheld: (a) the right of two children born of illegal resident parents to enrol in school; and (b) the Dominican nationality of the Haitian couple’s children. 20. (...) Lastly, Dominican civil status arrangements are a model that could be followed by many other poor countries.
