On the preliminary issue of receivability, the following facts were found to be established
by the Dispute Tribunal:1
… The Applicant’s post with [the United Nations Children’s Fund (UNICEF)],
Malawi[,] as Chief of Health and Nutrition was earmarked for abolition on

Nutrition he was also the Office Ombudsperson.
… On 25 January 2010, the Applicant made a formal complaint to the Office of
Internal Audit (OIA) that he was being sexually harassed by Ms.
