Social Rights are not just a bill of rights or programmatic principles to let it realize
by governments pleasure according to good or bad economic situations but, indeed, they are
obligatory standards according to rule of law at the national and international levels
especially United Nations international human rights system.
2. (...) It is important that National Human Rights Institutions continue to focus their efforts
on the realization of Social Rights, placing this as a priority in all of their activities and
their range of action, and specially, in resolving the complaints received, processing
specific cases by profession and reporting on the cases in order to give recommendations to
Governments, keeping in mind that Social Rights are obligatory and judicial processes on
serious violations of these rights must take place wherever the case.

According to the Article 42 of the Constitution of the Republic of Azerbaijan:
• Every citizen has the right to education;
• The state guarantees free obligatory secondary education;
• The system of education is under the state control;

• The state establishes minimum educational standards.
(...) Furthermore, the Law on the Rights of the Child stipulates the children’s right to education
and prohibition of evasion of children from obligatory general secondary education.
In all of its stages the education system should give correct direction to the formation of
independent thinking and democratic view of life. (...) In spite of the measures taken in the country in the field of children’s rights protection and
promotion, problems still exist and proactive participation and cooperation of state bodies
with local and international non-governmental institutions is obligatory for development
and implementation of integral strategy on children’s rights.

Similarly it is necessary: to define and delimit functions which
can be outsourced and for which national rules should be formulated; to adopt legislation and set
up supervisory machinery, in respect of those activities; to establish a registration and licensing
system and penalties; to lay down rules concerning the respect for human rights and international
humanitarian law; to make it obligatory to provide personnel with proper training also
encompassing human rights standards; to establish effective arrangements for selecting vetting
applicants; and lastly to make it obligatory to present periodic reports and to introduce a
monitoring system.
