Social Rights are not just a bill of rights or programmatic principles to let it realize by governments pleasure according to good or bad economic situations but, indeed, they are obligatory standards according to rule of law at the national and international levels especially United Nations international human rights system. 2. According to the Article 42 of the Constitution of the Republic of Azerbaijan: • Every citizen has the right to education; • The state guarantees free obligatory secondary education; • The system of education is under the state control; A/HRC/26/NI/1 4 GE.14-04270 • The state guarantees continuation of education for most privileged persons irrespective of their financial position; • The state establishes minimum educational standards. (...) Furthermore, the Law on the Rights of the Child stipulates the children’s right to education and prohibition of evasion of children from obligatory general secondary education. In all of its stages the education system should give correct direction to the formation of independent thinking and democratic view of life. (...) In spite of the measures taken in the country in the field of children’s rights protection and promotion, problems still exist and proactive participation and cooperation of state bodies with local and international non-governmental institutions is obligatory for development and implementation of integral strategy on children’s rights.

The principle of the non-use of force as stated in Article 2, paragraph 4 of the Charter and as circumscribed by Article 51, was an obligatory norm of international law which admitted of no exceptions. (...) They were, therefore, obligatory not only for States which were signatories to the Charter but for all States. (...) States should accept some obligatory, automatic means of settling international disputes. 11.

It envisages an extension of the area in which local broadcasters may broadcast (six service areas, not necessarily adjacent to each other); arrangements governing the programme/advertising balance; new rules for advertising and an obligatory requirement for government departments to devote at least 15% of their budget for institutional communication airtime to local broadcasters. Similarly it is necessary: to define and delimit functions which can be outsourced and for which national rules should be formulated; to adopt legislation and set up supervisory machinery, in respect of those activities; to establish a registration and licensing system and penalties; to lay down rules concerning the respect for human rights and international humanitarian law; to make it obligatory to provide personnel with proper training also encompassing human rights standards; to establish effective arrangements for selecting vetting applicants; and lastly to make it obligatory to present periodic reports and to introduce a monitoring system.

These principles could be summarized as follows: • Specific and detailed registration of PMSCs is required, with possible prohibition of offshore registration of such companies • Registration of PMSCs should be based on minimum transparency requirements, supposing regular (possibly annual) reporting of companies to the State bodies on main parameters of their foreign activities, change in structure, contracts over a certain size and other parameters to be defined by the State • A specific system of State licensing of PMSCs and especially of their contracts for operation abroad might be established, similar to arms licensing or export control licensing • Such licensing might presuppose requirements for obligatory training of personnel on norms of international humanitarian and human rights law, and require the verified absence of national and international criminal record among PMSCs employees • Human rights abuses prevention criteria are to be built into general export criteria for the military and security services industry • A State system of monitoring of activities and contracts of PMSCs might be established through a State inspectorate (possibly similar to BERR compliance officers), including investigations into reported cases of human rights violations committed by the companies or their employees • In addition to a monitoring mechanism, a complaint mechanism open to individuals, State agencies, foreign Governments and other companies should also be put in place to ensure criminal responsibility of individuals and civil liability on companies • The State must legally define the types of activities in the military and security area which under no circumstances could be outsourced to PMSCs, for example, access to weapons of mass destruction • National legislation on PMSCs should clearly list types of activities prohibited for nationally registered PMSCs, including mercenary-related activities banned by the International Convention against the Recruitment, Use, Financing and Training of Mercenaries, or participation in overthrowing legitimate Governments and political authorities A/HRC/10/14/Add.2 page 13 42. An enforcement mechanism should be put in place so that companies would have to follow the registration and obligatory transparency procedures, under the risk of not getting a license for foreign contracts or having such a license withdrawn. 45.
