REPORT OF THE SPECIAL RAPPORTEUR ON THE PROMOTION AND PROTECTION OF THE RIGHT TO FREEDOM OF OPINION AND EXPRESSION, FRANK LA RUE : ADDENDUM
The Special Rapporteur on the promotion and protection of the right to freedom of opinion and expression, Frank La Rue, undertook an official mission to the Republic of Korea from 6 to 17 May 2010, at the invitation of the Government. (...) This has led to the emergence of an active and vibrant online culture with active “netizens” exchanging diverse information, views and opinions online, including via discussion forums. (...) Furthermore, even if the original publisher contests the decision taken by online service providers to delete or block access to the information that he or she has disseminated online, the Network Act does not set out any requirements for the service providers to take any follow-up action.

With limited or no supervision from parents or guardians, children spend more time online making them more exposed to online child sexual predators. (...) The worsening economic situation may have pushed adults to resort to peddling children to sexual predators online “due to the lucrative nature of these activities.”2 Online sexual predators, on the other hand, are taking advantage of the situation to exploit more children to satisfy their disturbing sexual obsessions.3 (d) The Commission received reports of an “alarming prevalence” of online sexual harassment against women and girls. More recently, the lockdown imposed in 2020 due to the COVID-19 pandemic, when children had to resort to remote learning, increased their exposure to the risks of online sexual exploitation and grooming.18 Reported cases of online child sexual abuse and exploitation have been on the rise since that time. During their discussions, she learned that there is a lack of data on children exposed to online crimes and that among the difficulties associated with acquiring accurate data was the fact that children may not be aware of the nature of offences related to online child sexual abuse or they may not have the courage to speak up when they encounter a problem online. 28. (...) At the regional level, Montenegro acquired official status as a candidate for membership to the European Union in December 2010.

In respect of child labour and the related sale of children, there are no official data on the scope of the phenomena, which hampers the Government’s ability to adopt and implement effective policies. (...) The Special Rapporteur called on the national authorities to strengthen domestic legislation by prohibiting and criminalizing the accessing and sharing of child abuse material online. In that regard, she noted that Internet service provides would be interested in participating in consultations led by the Government with the aim of enhancing online child protection. 33. (...) The same criminal act, when committed with the abuse of official position by means of organizing the crossing of the State border or by means of fake adoption, is punished with 4 to 8 years of imprisonment.

While those groups face dire and unique challenges, urban poverty is significant. In recent years, law enforcement bodies have increased their efforts to combat the online sexual exploitation of children, in particular, the online dissemination of child abuse material. (...) Combating the sexual exploitation of children online: role of the business sector 42. The Special Rapporteur commends the important role played by the business sector in Japan in combating online child sexual exploitation.

The Kiev Equality March 2019 became unprecedented not only in the 2-number of participants, but also in their composition: for the first time, an official delegation of a government institution - the Public Health Center of the Ministry of Health of Ukraine - took part in it, columns of LGBTI persons - veterans and volunteers, who resisted the aggression of the Russian Federation, were formed for the first time, and also people with disabilities who promoted equality. On June 21, 2020, an all-Ukrainian online equality march was held, during which online viewers could leave their own tags on Google maps with slogans for LGBT+ rights, photographs of posters and various other messages. 13.

The Special Rapporteur on the rights to freedom of peaceful assembly and of association conducted an official visit to Oman from 8 to 13 September 2014. (...) The Special Rapporteur reiterates that States have the obligation to ensure that online assemblies are facilitated in accordance with international human rights standards. 35. (...) The Special Rapporteur was pleased to hear during his visit that the law was being reviewed, but expresses his disappointment that the Government did not share an official draft of the law or elaborate on the specific changes that were being made.
