With regards to shortcomings in the performance of law enforcement authorities and in the judicial system, the Special Rapporteur stresses the main concerns raised by the seven thematic special procedures in their 2009 combined report on technical assistance to the Government of the Democratic Republic of the Congo and urgent examination of the situation in the East of the country.2 She is further concerned that the human rights section of the Plan for the Reform of the Justice System is neglected by donors. 46. Human rights defenders suffer from a chronic lack of resources and funding, especially those who operate outside the capital and the eastern provinces where the international community mostly concentrates its efforts in assisting civil society.

The Special Rapporteur met with Lao people who were deeply committed to improving the well-being of all, but were struggling to operate in limited civic space, while providing health care, education and other services in remote areas with limited resources and uncertain pay. The Government and international partners cannot address poverty without an accurate understanding of the challenges facing the Lao people, but limited data collection and a lack of transparency make it difficult to accurately assess even the current state of poverty, which leads to programmes being designed around limited, outdated and sometimes misleading information. (...) While the authorities indicated to the Special Representative that the Commissioner-General had been misquoted, defenders reported numerous other statements attributed to government officials, and accurately or inaccurately reported in the press, denigrating NGOs, thereby damaging their credibility and public image. Human rights organizations complain that under the current policy no organizations are allowed to operate without registration, with non-registration rendering their status and activities illegal and liable to prosecution.

The Ministry of the Environment mentioned the challenges in distinguishing between waste and non-waste at the border and in accurately determining the amount of illegal shipments of electronic waste from Germany to other countries. 54. Germany commissioned a national study (2009-2010), in which it was calculated that 150,000 tons of electronic-waste were exported illegally from Germany in 2008.12 The Ministry questioned the reliability of the figures on the basis that it is extremely difficult to know accurately the content of containers, and was confident that German industry was usually not involved in illegal shipments. (...) Ship-breaking 55. German ship owners operate the world’s fourth largest merchant fleet in terms of vessels and have been linked to widespread contamination of the food, water and air of local communities, in addition to fatalities and toxic chemical exposure among workers, including child and migrant workers, who dismantle ships in hazardous and deadly conditions.
