In each case, provisions and commentary that deal with States’ obligations to provide access to
remedy in general are considered, with business-specific references noted at the end of each discussion.

2 (a) of the Convention obliges States “to ensure, through law and other appropriate means, the practical
realization” of the principle of non-discrimination between men and women, article 2 (c) requires States
“to ensure through competent national tribunals and other public institutions the effective protection of
women against any act of discrimination”, and article 2 (b) deals with sanctions against perpetrators. The
Convention also specifically refers to business in article 2 (e), under which States parties commit “to take
all appropriate measures to eliminate discrimination against women by any person, organization or
enterprise”.
37. (...) It is not clear whether States are obliged to prosecute legal persons, including
corporations, as well as individuals in cases where the accused is a private person acting with official
sanction.
42. Article 13 deals with the procedural aspects of remedy in requiring that any individual who
claims he or she has been subjected to torture in any territory under the jurisdiction of a State party “has
the right to complain to, and to have his case promptly and impartially examined by, its competent
authorities”.48 Article 12 provides for prompt and impartial investigations.
