Torture is defined as the intentional infliction of severe pain or suffering, whether physical or mental, for such purposes as to obtain information or a confession, to punish, intimidate or coerce the victim or a third person, or to discriminate, on any ground, against the victim or a third person. (...) In line with this, respect for the person demands the dignified treatment of all prisoners of war that is mindful of their sense of self-value, for example in relation to clothing. (...) As a result of the beatings, he received physical pain, fractures of the ribs, head injury and currently faces difficulties in moving.

Bere, our attitude is influenced by the common practice in France and many other countries as regards commercial and pri- vate law, especially company legislation and jurisprudence. (...) Therefore the text reads as follows: "Resolved that it is the sense of this As- sembly that members of Councils elected in January 1946 under the provisional rules of procedure shall hold office for twelve months and that elections of their successors shaH be -held at the second regular session of the Gen- erai Assembly." (...) There was a word in the original text to make it clear that we were only discussing people who are elected for a term of one year. 1 would like to have unanimous consent to change the text, so that it would read: "Re- solved that it is the sense of this Assembly that members of Councils e1ected in January 1946 for one year under the provisional rules of pro- cedure, et cetera."

Such experiences cause severe pain and suffering, which can result in a deterioration of mental health and lead to depression, self-isolation and suicidal thoughts. (...) Firstly, the Special Rapporteur heard reports of cases of what she has already identified as the perverse consequences of the mercantilization of health (A/HRC/41/47), which are at the root of a substantive number of the difficulties associated with the medical treatment of the disease, such as neuropathic pain, Hansen’s disease reactions and the iatrogenic effects of some of the drugs employed in treating the disease, such as clofazimine, which can produce changes in skin colour, becoming a stigmatizing mark of the disease for these women, and thalidomide, which affects sexual and reproductive health. (...) Furthermore, as a result of the social roles that continue to be attributed mainly to women, many women described how physical impairments, sometimes invisible ones like neuropathic pain and loss of sensation, made the performance of house work, childcare and care of other family members increasingly painful. 51.

In addition the Special Rapporteur concluded in paragraph 45 of the report that based on the medical evidence “indicated that the overall pattern of injuries was assaultive and indicative of blunt force” ….”The medical evidence strongly corroborated the allegations of the detainees who suffered broken limbs and other defensive type injuries” Consequently a determination was made that that severe pain was intentionally inflicted for the purpose of punishment amounting to torture. (...) The conclusion that there were acts of torture in places of detention While denying that torture in the classical sense of deliberately inflicting severe pain or suffering as a means of extracting a confession of information was a major problem in Jamaica, the Special Rapporteur noted in paragraph 36 that at the Horizon Remand Centre, for example, persons were subjected to different degrees of beatings for the purpose of punishment which he claims can also amount to torture.
