UNIVERSAL PERIODIC REVIEW : WRITTEN SUBMISSION BY THE LATVIA: OMBUDSMAN OF THE REPUBLIC OF LATVIA : NOTE / BY THE SECRETARIAT
Latvia has received a recommendation to facilitate the granting of citizenship to children of non-citizen parents, provided that these children are not obtaining another nationality. In this regard, Ombudsman would like to inform that the amendments which entered into force on 1 October 2013 improved the procedure for granting citizenship, whereby children of non-citizens and stateless persons can now receive Latvian citizenship at the time of registration of their birth and upon the request of one of the parents. However, such granting of citizenship cannot be considered automatic, since the will of one parent must be taken into account. (...) Therefore, Ombudsman appeals that the legal framework be improved, so that children are granted Latvian citizenship automatically at birth, unless the parents renounce it. In conclusion, the Ombudsman would like to declare its readiness for constructive cooperation with the Latvian government in the implementation of the recommendations.

This is frequently accompanied by threats to call the police unless the parent acquiesces. Extended family members, such as an uncle, sometimes use deceit to take the child to the market and sell the child to a middleman, such as when the child is not given voluntarily by the parents in return for forgiveness of his debts. (...) Most often the separation of the parents (often due to domestic violence or alcoholism) or the death or abandonment by the father had left the family in a state of destitution.

Malgré les améliorations, les jeunes filles sont toujours défavorisées dans l’accès à l’éducation. La préférence des parents pour l’éducation des garçons plutôt que celle des filles persiste, en particulier dans les zones rurales. (...) Parmi les activités des Clubs, on peut retenir : l’accompagnement des parents dans leurs demandes d’extrait de naissance, la sensibilisation des filles et des garçons contre le mariage forcé et les grossesses précoces, la possibilité pour les filles d’avoir accès à des classes passerelles, et l’accompagnement des parents pour l’inscription de leurs enfants à l’école. (...) La faible qualité de l’offre affectait également la motivation des parents à éduquer leurs enfants7. 73. Depuis lors, la situation a progressé.

Seminars, training courses and other events targeted at children, parents, and representatives of organisations dealing with children have been carried out for promotional purposes. (...) Thus, the Article 17 of the Convention on the Rights of the Child envisages the child’s right to live with parents and receive care from them. “State Program on De-institutionalisation and Alternative Care for the years of 2006-2015” was adopted based on the Decree of the President of the Republic of Azerbaijani of March 29, 2006 and the ultimate purpose of this program is to transfer children from the state institutions to family environment and establish as well as apply the mechanisms on arrangement of alternative care with the view of ensuring healthy development in family environment and integration into society of children who lost their parents and were deprived of parental care. (...) Apart from that, relevant measures were taken on the claims sent to the Commissioner by patients having the right to receive medicines, medical examination and treatment at government expense, parents of disabled children, diabetics, patients with kidney diseases, and in most of the cases the violated rights of applicants were restored.

I had to leave school when I was 13 and start working because my parents were poor and could not continue to pay for my schooling. (...) The rest went to my parents. My boss suggested that I go to France because I could earn more there. (...) Even some judges and lawyers who understand the weaknesses of the judicial system are reported to have informally advised some parents to take this course of action. These parents are then at risk of criminal proceedings for their actions, both in France and often in the country to which they travel.

The Special Rapporteur finds also extremely worrying that, according to studies, only 10 per cent of the parents of children who run away from home try to find their children, in other words, 90 per cent of parents of such children take no action to recover their “missing” children.10 C.

The main difficulties facing children in Rodrigues include high drop out rates, intrafamilial abuse, failing parents and parental alcoholism, as well as teenage pregnancy, in part due to insufficient and inadequate sexual education. (...) According to the national survey, for those children for whom both parents were alive, almost half the parents do not live together. (...) It focuses on prevention programmes, including collaborating with the École des Parents initiative (schools for parents), community child watch and district child protection committees (see para. 64 below) and runs Children’s Clubs for children between 3 and 18 years of age in 22 areas across the country. 54.

Paragraph 23 Regarding the alleged difficulties with interpretation of the law concerning consent of parents for advice on contraception in the case of minors, it should be stated that pursuant to the legislation being in force before 1 September 2009 participation of students in the classes was not obligatory and the condition for participation was acquirement of a written consent from parents of under-age students or from adult students themselves. (...) Under Article 53, paragraph. 3 of the Constitution of the Republic of Poland parents are granted the right to provide education to children in accordance with their convictions. (...) Paragraph 26 With reference to the Rapporteur’s call on the Polish Government to ‘further eliminate possibility for parents to object to the provision of sexuality education in schools’ we would like to remind that the Universal Declaration on Human Rights stipulates in Article 26 para 3 that ‘Parents have a prior right to choose the kind of education that shall be given to their children’.
