Article 9 of the Convention on the Rights of the Child addresses the protection and well-being of children who are separated from their parent or parents against their will, irrespective of the causes of the separation. (...) While the Convention recognises the need for States Parties to ensure the non-separation of the child from its parents in Article 9(1), the Convention also accepts that action initiated by States Parties such as detention, imprisonment, exile, deportation or death as set out in Article 9(4) can result in separation. (...) The thematic discussion should follow the framework of Article 9 of the Convention and focus on protecting the human rights and best interests of children who are separated from their parents against their will, irrespective of the causes of the separation.

The statistics include step-parent adoption. 8 In 2015-2016 the number of children whose birth parents were indicated in birth certificates upon a court decision increased considerably (39 cases as opposed to 4 cases in 2012-2014). In addition, this provision establishes that the commissioning couple are deemed to be the legal parents of the child while the donor or the surrogate mother has no right to be recognized as a parent of the child.

Children left behind as a consequence of parents’ emigration 57. A recent phenomenon, which has emerged as a consequence of the economic situation pushing parents to go abroad to find employment or better jobs opportunities, is what is referred to as “children left behind” without parental care. 58. Under the new standard any specialized institution or resident service must have a procedure devised for registration of death cases and must follow a notification sequence so as competent authorities, parents/guardians or trustees, and respective Social Assistance Directorate to be duly informed. The desire of families to maintain contact with their child and the actual capability to do so have been screened, and as a result parents of 90 children have initiated to get in contact with them; parents of 30 children have telephoned the respective home looking for information about their child, and parents/relatives of 60 children have visited the home to meet their child. (...) The Project ‘I have a Family’ covers actions to decentralize and widen the scope of foster care and develops services in support of foster parents. Project is expected to run for the period 30 September 2011 – 31 October 2013.

I f the father and the mother have no common residence the c h i l d s h a l l l i v e with that parent who has the right of care and education. (...) I f both parents cannot be considered for the education and care of the c h i l d , the B i l l provides. (...) I f the parental authority i s vested in-only one of the parents, the parent exercising parental authority s h a l l consent to the adoption, while the other parent s h a l l make a spec i a l declaration.
