On the basis of his discussions with government ministers and officials, the Representative noted a disparity between the generally negative perception of government policy and the positive attitude displayed by his interlocutors during his mission. (...) An open and constructive partnership involving the Government, civil society and international agencies would serve to advance the timely and effective implementation of the Government’s return and resettlement policy, while at the same time alleviating legitimate concerns and broadening the perception of the problem, both within and outside the country. (...) It should particularly be noted that prior to the mission of the Representative of the Secretary-General there was an overall perception that the Government has essentially denied the existence of the displacement problem.

The Special Rapporteur considers that, despite improvements in the High Council of Judges and Prosecutors, the current position and functions of the Minister of Justice within the High Council may jeopardize the full respect of the independence and impartiality of the judiciary and the perception thereof. Hence, an additional effort would be needed to ensure that the High Council is totally independent from the executive branch, both structurally and functionally. 33. (...) This proximity between judges and prosecutors is a matter of concern in relation to the principles of impartiality and equality of arms and also has an impact on the society’s perception of the judiciary as a whole. As rightly observed by one interlocutor during the mission, “equality of arms needs to be both physical and psychological”. (...) She would like to stress at the same time the need to always respect judicial guarantees for all suspects, including regarding the length of the pre-indictment and pretrial detention period, as well as the proper collection of evidence and the full respect of the right to defence.
