The Constitution of Sri Lanka contains a fundamental rights chapter reflecting the rights to equal protection before the law, non-discrimination, freedom of movement and choice of residence.8 Following the assassination of the Foreign Minister in August 2005, a state of emergency was declared, and the President has since adopted a series of emergency regulations. 6 Preamble to the Universal Declaration of Human Rights, UNGA, 10 December 1948 (UDHR). 7 The Charter of the North-East Secretariat for Human Rights “recogniz[es] the Universal Declaration of Human Rights and other United Nations Human Rights instruments” and states as its objective, “promot[ing] recognition and respect for the human rights and the basic freedoms of the people of the Northeast of this Island according to [the UDHR and the major human rights conventions to which Sri Lanka is party]”. 8 The Human Rights Committee has observed that “Sri Lanka’s legal system still does not contain provisions which cover all of the substantive rights set forth in the [International Covenant on Civil and Political Rights], or all of the necessary safeguards required to prevent the restriction of Covenant rights beyond the limits permissible” (CCPR/CO/79/LKA), para. 7.

EUROPEAN CONVENTION ON INTERNATIONAL COMMERCIAL ARBITRATION : DRAFT SET OF FINAL CLAUSES SUBMITTED BY THE SECRETARIAT
From the outset, the Working Group, when it drew up the first draft European Convention on International Commercial Arbitration decided, at its sixth session, that the convention should expressly leave the parties free to choose between ad hoc arbitration and the settlement of their disputes by an arbitral institution. Having made that choice, the parties would be completely free, if they decided in favour of ad hoc arbitration, to take all necessary steps to appoint the arbitrators or establish means for their appointment in the event of an actual dispute, to determine the place of arbitration and to lay down the procedure to be followed by the arbitrators. (...) In some European countries ad hoc arbitration is regarded us the normal method of settling disputes, whereas in others reference to a permanent arbitral institution is preferred. Several delegations accordingly felt apprehensive at the possibility that the President of the competent Chamber of Commerce, who would normally be the President of the Chamber of Commerce of the respondent's country, might, in the case of an "open" arbitration agreement, impose the methods in use in his country rather than those which the claimant preferred and to which he was accustomed. 8. In the latter case, indeed, the powers of the President of the competent Chamber of Commerce were deemed by certain delegations to be so wide that а corrective seemed imperative, in the form of a provision for the rescission of the arbitration agreement where the claimant considers it preferable not to leave the choice of the method of arbitration to that president.

In that regard, as is clearly stated in the 2010 Inter-Agency Standing Committee framework on durable solutions for internally displaced persons: “An IDP’s choice of local integration or settlement elsewhere in the country, in the absence of the option to return, must not be regarded as a renunciation of his/her right to return should that choice later become feasible.” (...) One of the main obstacles to the achievement of durable solutions is the coiled razor wire fences along the administrative boundary line of the Tskhinvali region/South Ossetia, Georgia, which continue to deprive internally displaced persons and communities affected by displacement of freedom of movement and of choice of residence, creating tangible obstacles to their access to land, property, water and livelihoods. Monitoring missions have observed that although the installation of fences has decreased since 2013, obstacles to freedom of movement and the choice of place of residence continue to be placed along the administrative boundary line, including so-called State border signs, watchposts and surveillance equipment (see A/70/879, para. 21). 27.
