The Working Group encourages the Government to ensure, in practice, that all persons are informed upon apprehension of their right to legal assistance by counsel of their choice or at no cost if they cannot afford a lawyer, in conformity with section 44 of the Criminal Procedure Act.7 The authorities must also ensure that all detained persons are afforded, in law and in practice, all fundamental legal safeguards from the outset of their deprivation of liberty, including prompt access to a lawyer or to free and effective legal aid during all proceedings.8 4.
