As the text of a resolution has already been approved without dissent by a meeting of the First Committee at which all Delegations were represented (E/CONF.2/C.1/SR.10 and E/CONF.2/27), and as presumably it is desirable not to delay consideration of this Resolution until the mid-summer session of the Economic and Social Council, It might be suggested that the text given in E/CONF.2/27 be regarded as having been approved by a Planary Session of the Conference in order that it might be transmitted to Lake Success in time for discussion at the current session of the Council.

Considering that when States agree to provisional application they are presumably seeking to enjoy the benefits of a treaty commitment, it would seem natural to conclude that article 46 remains relevant, regardless of whether a treaty is in force or provisionally applied. (...) It may be necessary, however, to provide some additional clarifications with regard to what constitutes an acceptable method of signaling an intention not to become a party to a treaty. The process would presumably need to be different if a State has merely signed a treaty without ratifying it, or if a State has completed the necessary ratification procedures but the treaty itself has not yet entered into force and is still being provisionally applied by the parties. (...) Si une telle application a des effets juridiques, comme le rapporteur special le laisse entendre dans sa directive preliminaire n° 3, ii faut done presumer que les Etats seront tenus d'exprimer officiellement leur consentement a etre lie.
