Ainsi, nous considérons que le fait d’avoir donné pour toute
réponse un rejet pur et simple, en particulier après avoir été informés du souhait qu’avaient les
producteurs indiens d’offrir des engagements, constituait de la part des Communautés
européennes un manquement à l’obligation d’“explorer les possibilités de solutions
constructives”, et nous concluons par conséquent que les Communautés européennes n’ont pas
agi d’une manière compatible avec leurs obligations au titre de l’article 15 de l’Accord
antidumping (...) L’analyse présentée dans une étude27 sur l’application du seuil de 2 % dans les enquêtes
antidumping de l’Union européenne de 1995 à 2000 pour des produits textiles a montré
qu’environ 25 producteurs originaires de six pays avaient ainsi été exonérés. La même analyse
a permis d’observer qu’à un seuil de 5 %, neuf autres producteurs auraient été exonérés.
À partir de cette première tentative, il conviendrait de réaliser de nouvelles analyses pour
renforcer encore cet argument en faveur d’un relèvement des seuils, en ayant présent à l’esprit
que les autorités d’enquête conservent toujours la possibilité de déterminer des marges de
dumping supérieures à la marge de minimis.

Decides that, where a Party included in Annex I undertakes a corrective transaction
to reflect a correction to the compilation and accounting database applied by the
Compliance Committee, pursuant to chapter V, paragraph 5(b), of the annex to decision
27/CMP.1, the information in the compilation and accounting database shall be
appropriately amended to avoid double counting, following the review of the corrective
transaction in accordance with Article 8 of the Kyoto Protocol and the resolution of any
questions of implementation;
15. Also decides to extend the code of practice for the treatment of confidential
information for the reviews of inventories under Article 8 of the Kyoto Protocol to the
review of assigned amount information under Article 8 of the Kyoto Protocol;
16. (...) For the purpose of the second commitment period, after completion of the
initial review under Article 8 of the report to facilitate the calculation of the assigned
amount pursuant to Article 3, paragraphs 7 bis, 8 and 8 bis, in accordance with ,

in the database for the compilation and accounting of emissions and assigned
