The
most salient example relates to the management of the Pacific Project. One of the
Applicant’s supervisors, together with a Consultant, conducted a review mission of
this project. (...) The Applicant argues that the post he encumbered was fully funded by the
Donor Country through funds earmarked for the Pacific Project. Pointing out to the
fact that he was called to assist in other projects, representing approximately 40%
of his functions, he then asserts that ITC used part of the Pacific Project funds for
other projects without the donor’s approval. (...) Neither can the Applicant demonstrate how project funds earmarked for
specific-projects were to be diverted to ensure that he could continue to be
employed as a P-4 on the Pacific Project.

From the parties’ submissions, it is apparent that “UNOPS project 00071445”, which
the Applicant was appointed to, is a project entitled “Specialised Training of the
Judiciary and Law Enforcement Authorities to Address Organised Crime and Global
Challenges Enhancing Capacity Building of the Lao Criminal Justice System” (“the
Project”). (...) The Applicant’s contract was not extended due to a lack of funding,
not underperformance as he suggests. UNICRI is a project-based Institute and
project officers’ salaries, including the Applicant’s, are fully covered by funds
directly linked to projects funded by donor countries. (...) The Applicant was appointed to and for the Project. No acceptable evidence
has been put before me that the Project has been terminated.

The end of the project was followed by a limited extension pending the
creation and implementation of the new Access to Justice project. (...) The new project had a significantly
lower budget than the Rule of Law project and was composed of 11 positions,
compared to 26 in the preceding project.
17. (...) The evidence rather shows that the Applicant’s post was abolished when the
project to which it was attached ended in December 2017, and that her contract was
extended for an additional period of six months to cover the limited extension of the
project pending the creation and implementation of a new project.
