(1) Without limiting the jurisdiction of the court to make a declaration, the court may make a declaration, that: (a) an act does not; or (b) a proposed act would not; constitute an infringement of a patent in proceedings between the person doing or proposing to do the act and the proprietor of the patent. (2) The declaration referred to in subsection (1) may be made notwithstanding that no assertion to the contrary has been made by the proprietor if it is shown that: (a) the person has applied in writing to the proprietor for a written acknowledgment to the effect of the declaration claimed, and has furnished the proprietor with full particulars in writing of the act in question; and (b) the proprietor has refused or failed to give any such acknowledgment.

Application to register trade marks registered in United Kingdom Any person being the registered proprietor of a trade mark in the United Kingdom by virtue of an entry in the register of trade marks kept under the Trade Marks Act, 1938, of the United Kingdom or any Act amending or substituted for that Act, or any person deriving title from such registered proprietor by assignment or other mode of transfer, may apply at any time during the existence of the registration in the United Kingdom to have such trade mark registered in Vanuatu in respect of some or all the goods comprised in the United Kingdom registration. 3. Entry in Register of assignments Subject to the provisions of this Act, where a person becomes entitled by assignment or other mode of transfer to the privileges and rights conferred on a registered proprietor by this Act, the Registrar shall, on application being made in the prescribed manner and on proof of title to his satisfaction, cause such person to be entered in the Register as subsequent registered proprietor of the trade mark. 10. Alteration of Register The Registrar may, on request in writing made by the registered proprietor and on payment of the prescribed fee – (a) cancel the registration of a trade mark or of a registered user thereunder either wholly or as regards any particular goods in respect of which the trade mark or registered user is registered; (b) correct any clerical error in, or in connection with, any application under this Act or in any matter which is entered in the Register; (c) enter in the Register any change in the name, description or address of the person who is registered as proprietor or user of a trade mark. 16.

Arbitration courts shall examine and settle economic disputes and other cases to which legal entities and sole proprietors are parties as well as the cases (specified in this Code and other legislative acts) to which the Republic of Tajikistan, government and other agencies, officials, entities with no legal status, and individuals not ranked as sole proprietors (hereinafter referred to as “individuals” and “entities”) are parties. 3. In case samples of products held in the Customs control are required to conduct certification of the goods (products), the proprietor (owner) must address the Customs Authority in writing for such samples, based upon a contract between a proprietor (owner) of goods (products) and the certification body rendering certification services, or with a written confirmation of such contracts by the certification body, containing the number of the contract, the date of signature, the period of carrying out the work, and the necessary number of samples. If the certification requires testing resulting in a loss of the goods, the owner (proprietor) submits a proper written notice to the Customs Authority and submits an act of sample destruction, issued by the certification authority. The value of the samples is included in the value of goods (services) in the Customs declaration. 7. If the proprietor (owner) of goods (products) does not receive a conformity certificate for goods (products) or a certificate of recognition of a foreign certificate, the goods (products) have to be placed in a licensed Customs warehouse or removed from the Customs territory of Ukraine.
