According to MHA, involuntary psychiatric treatment shall be applied only on the basis of a court ruling. (...) Besides of inpatient coercive psychiatric treatment, this type of therapy may also be administered in the form of out-patient treatment if the person does not pose danger to himself or herself and the society upon subjection to coercive psychiatric treatment and it is likely that the person adheres to the treatment regime. (...) The procedure for administration of coercive psychiatric treatment is regulated also in the CCrP.

Nevertheless, placement in psychiatric establishments of adults with intellectual disabilities is commonly justified on the grounds of “seriously aggressive and/or irresponsible behaviour,” not because the person demonstrates such behaviours, but because it is presumed that such behaviours can (and will) occur. (...) In fact, they are far more likely to develop behaviour problems by being placed in psychiatric institutions, than to be cured of them in such settings. (...) Training manuals for staff may openly condone physical restraints and seclusion. Electro- convulsive therapy and “aversive techniques” involving physically or emotionally painful stimuli may be applied to modify and/or control behaviour.

b. Electroconvulsive therapy 61. The use of electroshocks on prisoners has been found to constitute torture or ill-treatment.27 The use of electroshocks or electroconvulsive therapy (ECT) to induce seizures as a form of treatment for persons with mental and intellectual disabilities began in the 1930s.28 CPT has documented instances in psychiatric institutions where unmodified ECT (i.e. without anaesthesia, muscle relaxant or oxygenation) is administered to persons to treat their disabilities, and used even as a form of punishment.29 The Special Rapporteur notes that unmodified ECT may inflict severe pain and suffering and often leads to medical consequences, including bone, ligament and spinal fractures, cognitive deficits and possible loss of memory.30 It cannot be considered as an acceptable medical practice,31 and may constitute torture or ill-treatment. Noting the ban on opioid substitution therapy in the State party, the Committee is concerned by consistent reports that the law enforcement deliberately uses the withdrawal syndrome of drug users deprived of liberty in order to elicit coerced confessions, and that the courts admit such evidence. (...) Involuntary placement in psychiatric institutions 38. The Committee is concerned at consistent reports that the law enforcement uses involuntary placement in a psychiatric institution as a form of harassment and punishment against political opponents and activists, particularly those in Crimea, including the involuntary hospitalization in 2016 of Ilmi Umerov, the Mejlis Deputy Chairman, and five Crimean Tartar men suspected of being terrorists. The Committee regrets information that in practice, courts do not always respect the law requiring patients’ presence at the proceeding considering their involuntary hospitalization; that patients held in psychoneurological hospitals (PNIs) are prohibited by staff from filing complaints or accessing legal counsel; and that no effective monitoring mechanism exists for the situations in psychiatric institutions (arts. 11 and 16). 39. The State party should: (a) Take measures to put an end to the practice of involuntary placement in a psychiatric institution, particularly in Crimea; (b) Ensure that all persons are guaranteed, in law and in practice, effective safeguards concerning their involuntary internment and psychiatric and medical treatment in psychiatric institutions; (c) Establish an effective independent monitoring mechanism to review the situations of psychiatric institutions, and allow the POCs and non-governmental organizations to conduct monitoring visits to these institutions.
