Australia recognized the complaints process under CAT and CERD in 1993. 10. (...) The waiting lists for public housing are very long and waiting periods can be up to 10 years, depending on the level of priority of the households according to state criteria. Priority groups are determined differently from state to state.23 It is reported that criteria are becoming more and more stringent to accommodate the growing demands and the diminishing level of social housing stock. For the first time, the racial character of the violence suffered during the internal armed conflict is being recognized. 35. In a historical trial in the case of the 1982 massacre in Dos Erres, concluded on 2 August, the court found four former military officers guilty of “crimes against the duties of humankind” and assassination, and ordered the Public Prosecutor’s Office to continue investigations until all those responsible are brought to justice. In line with recommendations made by the Human Rights Committee20, the Committee on the Elimination of Discrimination against Women21 and the Special Rapporteur on the right to health22, it is necessary to widen the criteria established by the criminal code for the exemption from punitive measures for abortion, at least in cases of sexual violence and medical emergencies. (...) Although State institutions recognized the need to provide these peasants with alternatives to prevent land transfers, no effective protective measures were implemented.

The Court notes Cambodia's argument whereby it "could not have reached such a conclusion if it had not first recognized that a legally established frontier existed between the two Parties in the area in question". It also recalls that the Applicant implies that, in the reasoning of the 1962 Judgment, the Court considered that the two Parties had, by their conduct, recognized the line on the map in Annex Ito Cambodia's Memorial (hereinafter the "Annex I map"), a map drawn up in 1907 by the Franco- Siamese Mixed Commission, as representing the frontier between Cambodia and the Kingdom of Thailand (hereinafter "Thailand") in the area of the Temple of Preah Vihear it also observes that Cambodia invokes the jurisprudence of the Court whereby, "while in principle any request for interpretation must relate to the operative part of the judgment, it can also relate to those reasons for the judgment which are inseparable from the operative part". (...) The Court recalls that a dispute within the meaning of Article 60 of the Statute must be understood as a difference of opinion or views between the parties as to the meaning or scope of a judgment rendered by the Court, and that the existence of such a dispute does not require the same criteria to be fulfilled as those determining the existence of a dispute under Article 36, paragraph 2, of the Statute.

While the law is clear regarding the criteria that have to be fulfilled to become a judge, the Special Rapporteur was told that, in practice, the mandatory examination lacks both transparency A/HRC/26/32/Add.1 7 GE.14-14042 and anonymity. (...) There is also a real risk that newly appointed judges may feel indebted towards the president of their court. When selection criteria are objective, clear, based on merit, transparent, and well- publicized, public understanding of the process increases and the perception of fair selection or appointments is strengthened. (...) Some regions have begun to address the gaps in the provision of legal aid by adopting their own legislation to extend the eligibility criteria. Saint Petersburg, for instance, now has a city law on legal aid for indigent persons.

In developing the modalities, the Adaptation Committee (AC) and the Least Developed Countries Expert Group (LEG) considered the types of efforts that should be recognized, how to recognize those efforts and who should recognize them. These steps have been recognized by the COP; most recently, the COP urged developed country Parties to continue to scale up climate finance and to continue their efforts to channel a substantial share of public climate funds to adaptation activities.13 18. (...) In their 2016 road map to achieve the goal of jointly providing USD 100 billion annually by 2020 for mitigation and adaptation, developed countries recognized that adaptation is a priority for many developing countries and committed to significantly increasing finance for adaptation.
