The lack of strict criteria for their selection allows, in practice, the appointment of candidates who may not have the necessary skills and qualifications, but who are chosen solely on the basis of their political affiliation. 35. The issue of post-sentence preventive detention was recognized as highly problematic in all the meetings with government legal officials in federal and state ministries, prosecutors, prison officials and judges. (...) Pressure on psychiatric diagnostics, given the uncertainty as to what constitutes a mental disturbance in medicine and in law, and the questionable prospects of treatment or therapy in instances where there is no recognized treatment are issues that need further attention and clarity. (...) This phenomenon may be due to factors such as the residence and immigration laws, the vulnerable socio-economic position of many such detainees, and/or a lack of language skills or social support. The criteria used to determine who is to be held in pretrial detention can also have an adverse impact on foreigners. 64.

• Democratization of land access and appropriate use: mechanisms and guarantees which enable the largest possible number of men and women living in rural areas, and who are landless or have insufficient land, to gain access to it, and which encourage appropriate land use under criteria of environmental sustainability, aptitude, territorial management and community participation. Administrative expropriation for reasons of social interest and public utility and the administrative cancellation of ownership owing to non-use (cancellation of ownership of uncultivated land) will be applied pursuant to the Constitution and following the criteria established in the laws in force. 1.1.2. The beneficiaries of the free distribution plan and the full subsidy will be chosen by the competent administrative authority, with the participation of the local communities — both men and women — to guarantee transparency and effectiveness, through a legally defined procedure that includes objective requirements and criteria and observes the aforementioned prioritization.

For over a decade, judicial reform efforts have been stimulated in Romania by its process of accession to the EU.1 In light of the recommendations made in the framework of the accession partnership launched in 1999,2 Romania initiated steps aimed at meeting the accession criteria related to the functioning of the judiciary. The principle of an independent judiciary is recognized in article 124 of the Constitution of Romania,12 which also recognizes that justice is to be rendered in the name of the law, and with due respect for the principles of impartiality and equality.13 A. The Special Rapporteur stresses the importance of ensuring the appropriate safeguards for the immunity of magistrates, which requires the establishment of objective criteria for the assessment of misconduct (art. 99) by the SCM, especially in order to avoid improper or undue use of disciplinary proceedings and sanctions (art. 100). 54.

These cooperatives are recognized and legally supported in line with the Agricultural Producers’ Organization Funding Act (2000) However, despite these benefits, the Special Rapporteur heard testimonies that small-scale farmers face difficulty in gaining market entry owing to high barriers, including competition against large supermarket chains. While the new law will still allow free trade between farmers with some strict criteria and provides for some exceptions (such as acquisitions for public projects and religious institutions), it will make it difficult for industrial producers, individuals without farming experience and foreigners to buy large tracts of land (over 300 ha). (...) It is tasked with reviewing and authorizing the sale of farmland in accordance with the criteria laid out in the new law. The Agency is also entitled to carry out inspections in order to ascertain whether certain obligations set out in the new law, including whether the obligation to live for five years after the acquisition of farmland in a specified commune is being fulfilled. 19.
