Even though the main Tsarist legal act on indigenous people, the 1822 “Regulation of Indigenous Population”, recognized the role of clan community leadership and even prohibited Russians from settling in the territories of indigenous people without their leaders’ permission, indigenous communities suffered many effects of colonization, including military conflicts, loss of autonomy and lands, and heavy taxation. (...) With regard to indigenous peoples in particular, article 69 provides that “[t]he Russian Federation shall guarantee the rights of the indigenous small peoples according to the universally recognized principles and norms of international law and international treaties and agreements of the Russian Federation”. 17. With respect to international law generally, article 15 (4) of the Constitution states: “The universally-recognized norms of international law and international treaties and agreements of the Russian Federation shall be a component part of its legal system.

Furthermore, most European Union member States have ratified the Treaty on Stability, Coordination and Governance in the Economic and Monetary Union, which introduced stricter deficit criteria in 2013 that require its members to limit their structural deficits to 0.5 per cent of GDP. 8. While international human rights bodies have recognized the constraints that States may face during a financial crisis, there are limits on the extent to which States may deviate from their obligation to realize economic, social and cultural rights to comply with conditions imposed by their creditors.

However, the Special Rapporteur was informed that many fathers of limited means have serious difficulty in paying their children’s enrolment fees, even when those fees are low, and sometimes withdraw them from school; he was also informed that the criteria for determining which children will benefit from financial assistance are not very clear. 32. (...) A problem common to all these children is the lack of documentation, which is an insuperable obstacle as regards access to education since, as was mentioned previously, no child may be enrolled in any recognized public education institution unless he/she has a birth certificate.48 (i) Refugees and asylum-seekers 35. (...) Many of these children were abandoned by their parents when they were detained or deported, pursuant to the Immigration Act57 and found themselves in the situation of not being recognized as Malaysians, despite the fact that many of them had been born in Malaysian territory, nor as Filipinos or Indonesians, because they had not been born in either of those countries.

The call for proposals provided the background information, procedure for proposal submission, and selection criteria. In addition to the standard criteria for reviewing GEF climate change projects, the Call for Proposal placed emphasis on, among others, consistency of targeted technology with national priorities as identified in the TNAs, national communications to the UNFCCC, or other national policy documents, innovative technologies and mechanisms for technology transfer, as well as highly leveraged projects, including investments from both the public and the private sector, as well as South-South technology transfer and international collaborative projects. Topics covered included: methodology and tools for prioritization of technologies, multi- criteria analysis, financial assessments of technologies, and facilitation of effective stakeholder consultation. (...) As a result, the multi-criteria analysis tool of the handbook (TNAsses) could not be used during the regional workshops held in September 2010.
