Only about 300 of the 1,000 estimated licensed recruitment agents in Sri Lanka are members of ALFEA, owing to a clause in the 2009 amendment to the Act which changed the mandatory requirement for all licensed recruitment agents to join the Association. The draft Employment Migration Authority Act provides that all licensed agents must become members of a new association which will replace ALFEA, the National Chamber of Licensed Foreign Employment Agencies. The Chamber will inter alia ensure the strict observance by its members of the Code of Ethical Conduct for Licensed Foreign Employment Agencies. 40. Brokers, or sub-agents, who are not licensed or accountable to the Sri Lankan authorities often engage in irregular recruitment practices.

The Working Group was informed by the Ministry of the Interior that 117 PMSCs are currently licensed (or in the process of renewing their license) in accordance with the procedure first established in 2004 by Coalition Provisional Authority (CPA) memorandum 17 to operate in Iraq (see section III.D below). (...) It requires its members to be licensed or in the process of obtaining a license from the Iraqi Ministry of the Interior, or the Ministry of Interior of the Kurdistan Regional Government, or both. (...) It should be noted here that PMSCs operating in the Kurdistan Region must be registered with the Ministry of Interior of the Kurdistan Regional Government (KRG).

It has a license to import armoured vehicles. The company informed the Working Group that since 2012, it has also been licensed to operate in Puntland. 22. (...) Its primary client is the Africa Oil Corporation, a company registered in Canada (and licensed by the Puntland authorities)16 that leads a consortium of foreign oil companies.

By “illegal recruitment” RA 8042 not only means illegal recruitment of non-licensed entities, but also the malpractice of licensed agencies. (...) LAD forwards the case to the Operation and Surveillance Division (ODS) which checks if the agency is licensed. If it isn’t, ODS ensures that it stops operating. (...) A criminal action arising from illegal recruitment must be filed with the Regional Trial Court of the province or city of residence of the offended party, or where the act was committed.
