Only about 300 of the 1,000 estimated licensed recruitment agents in Sri Lanka are members of ALFEA, owing to a clause in the 2009 amendment to the Act which changed the mandatory requirement for all licensed recruitment agents to join the Association. The draft Employment Migration Authority Act provides that all licensed agents must become members of a new association which will replace ALFEA, the National Chamber of Licensed Foreign Employment Agencies. The Chamber will inter alia ensure the strict observance by its members of the Code of Ethical Conduct for Licensed Foreign Employment Agencies. 40. Brokers, or sub-agents, who are not licensed or accountable to the Sri Lankan authorities often engage in irregular recruitment practices.

The consultation brought together 22 participants from the judicial service, academics, civil society, the Inter-American Commission on Human Rights and the OHCHR Regional Office to discuss current challenges to the independent action of the judiciary, such as procedures for the selection, appointment or election of magistrates and judges in the region. (...) The Special Rapporteur’s initiative was well received by the participants, who termed it necessary and appropriate, since comparative regional studies on the subject are rare. 4. The Special Rapporteur thanks the Governments concerned for their extensive cooperation, the experts for the information provided and the OHCHR Regional Office for its assistance. (...) The judges are appointed through a complex process in which the Chief Justice of the Court is appointed and removed by a three-quarters vote of the Member States of the Court on the recommendation of the Regional Judicial and Legal Services Commission. (...) It should be noted here that PMSCs operating in the Kurdistan Region must be registered with the Ministry of Interior of the Kurdistan Regional Government (KRG). (...) They also recall that only PMSCs licensed with the Ministry of Interior are allowed to operate in Iraq. 40.

LAD forwards the case to the Operation and Surveillance Division (ODS) which checks if the agency is licensed. If it isn’t, ODS ensures that it stops operating. (...) A criminal action arising from illegal recruitment must be filed with the Regional Trial Court of the province or city of residence of the offended party, or where the act was committed.

Legislative framework (a) International and regional framework 26. Kuwait is a party to the Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children, supplementing the United Nations Convention against Transnational Organized Crime and other international human rights instruments, including the Slavery Convention of 1926, the Convention on the Elimination of All Forms of Discrimination against Women and the Convention on the Rights of the Child. (...) Employment agencies are subject to increased regulation that stipulates their obligations vis-à-vis the Government, employers and workers. All licensed recruitment agencies are prohibited from charging workers any amount for their recruitment or employment, either directly or indirectly.19 While they are registered and licensed by the Ministry of Commerce and Industry, their work is monitored by the Public Authority for Manpower.
