The initial mandate of the Programme was to provide assistance, mainly social, to the relatives of disappeared detainees and victims of political execution whose remains had not been returned to their relatives. (...) The Working Group is particularly concerned about the information provided by some relatives of disappeared individuals and associations of relatives of victims concerning their lack of trust in the Human Rights Programme, and the absence of interaction of this Programme with the main associations of relatives of victims. The rights of the victims and relatives of persons disappeared at the hands of LTTE should be protected and restored equally. 10. (...) Most importantly, the Commission referred to the relatives of missing persons and affirmed their right to truth and to legal remedies. (...) The court gave instructions for statements from relatives who believe that their family members were buried at the site to be recorded.

In addition, the Working Group wishes to thank civil society organizations, associations of relatives of the victims of enforced disappearance and, in particular, the relatives who provided information and testimony. (...) This is an important factor for protecting the genetic information of disappeared persons and their relatives, especially in the case of the “Dirty War”, as some of the victims’ relatives have now died of old age. (...) For this reason, a number of victims, relatives and organizations supported its work and provided it with information.

The Working Group met a number of relatives of disappeared persons and also held several meetings with civil society organizations and lawyers. (...) The Working Group received little information on reparation programmes for relatives of the disappeared, most likely because such programmes do not seem to exist. (...) There is no place for the relatives to gather to remember their loved ones.

Even after DNA analysis and cross- checking with the DNA database, which contains blood samples from over 97 per cent of the relatives of the victims, no match has been found in those cases. (...) The Commission is in charge of cooperation with relatives of disappeared persons and their associations. 22. (...) The legislative framework provides for free legal aid to defendants, but not to the 4 victims of the offence and their relatives, which poses a serious challenge for some relatives of the disappeared. (...) That definition does not enable the relatives of a disappeared person to 5 be recognized as victims in criminal proceedings. (...) A number of family members of disappeared relatives have not received any compensation or financial support.

The Working Group also expresses its gratitude to the associations and relatives of disappeared persons who provided information and testimonies during the visit. 4. (...) The Institute has managed to compile approximate figures, establish some contact with relatives and set up a database. It has also mapped a number of suspected burial sites in cooperation with victims’ associations and relatives. (...) Article 19 of the Declaration imposes upon States the obligation to provide reparation to the victims and their relatives in cases of enforced disappearance, and to provide them with adequate compensation.
