The initial mandate of the Programme was to provide assistance, mainly social, to the relatives of disappeared detainees and victims of political execution whose remains had not been returned to their relatives. (...) The Working Group is particularly concerned about the information provided by some relatives of disappeared individuals and associations of relatives of victims concerning their lack of trust in the Human Rights Programme, and the absence of interaction of this Programme with the main associations of relatives of victims. (...) The relatives of the victims recognized by the Valech II Commission have the same rights.

In addition, the Working Group wishes to thank civil society organizations, associations of relatives of the victims of enforced disappearance and, in particular, the relatives who provided information and testimony. This is an important factor for protecting the genetic information of disappeared persons and their relatives, especially in the case of the “Dirty War”, as some of the victims’ relatives have now died of old age. (...) For this reason, a number of victims, relatives and organizations supported its work and provided it with information.

That is a significant barrier to the realization of the rights of the relatives of the disappeared. In the absence of such a law, the only possible way for relatives of the disappeared to potentially qualify for any compensation or pension as a war victim is to legally declare the disappeared relative dead. (...) The legislative framework provides for free legal aid to defendants, 4 but not to the victims of the offence and their relatives, which poses a serious challenge for some relatives of the disappeared. (...) A number of family members of disappeared relatives have not received any compensation or financial support.
