Renforcer la base normative de l’article 1er par un renvoi aux articles 25 et 27 de la
Constitution et à l’article 19 du Pacte international relatif aux droits civils et politiques
(PIDCP).

- Transférer les dispositions relatives à la clause de conscience prévues dans l’avant-
projet à cette section (Dispositions générales relatives à la liberté de la presse et de
l’édition).
2.3 Recommandations relatives à l’entreprise journalistique
Modifier l’article 9 du projet pour permettre au Conseil de la concurrence, et non au
ministère de la Communication de veiller et de sanctionner éventuellement les pratiques
contraires aux principes de la concurrence libre et loyale.

In addition, the Working Group expresses its gratitude to the
associations of relatives of disappeared persons, the civil society organizations and, in
particular, the relatives who provided information and testimonies. (...) In
addition, it met with numerous national and international NGOs, relatives of victims of
enforced disappearance, persons who have been the victims of enforced disappearance and
other stakeholders in society, including former members and the relatives of members of
the Peruvian security forces.

The initial mandate of the Programme
was to provide assistance, mainly social, to the relatives of disappeared detainees and
victims of political execution whose remains had not been returned to their relatives. (...) The Working Group is particularly concerned about the information provided by
some relatives of disappeared individuals and associations of relatives of victims
concerning their lack of trust in the Human Rights Programme, and the absence of
interaction of this Programme with the main associations of relatives of victims.

relatives of the victims recognized by the Valech II Commission have the same rights.

Even after DNA analysis and cross-
checking with the DNA database, which contains blood samples from over 97 per cent of the
relatives of the victims, no match has been found in those cases. (...) The Commission is in charge of cooperation with relatives of disappeared persons and their
associations.
22. (...) That is a significant obstacle to the realization of the rights of the relatives of the
disappeared. In the absence of such a law, the only possible way for relatives of the disappeared
to qualify potentially for any compensation or pension as a war victim is to legally declare the
disappeared relative dead.
