All legal systems endeavoured to provide justice and rights for E/CN.4/2003/63 page 23 victims not only by dealing with perpetrators, but also by offering remedies, compensation, and protection. The Guidelines were nothing new, insofar as they simply reflected the principles and procedures of the various national systems relating to redress for victims.

To actively consider how their mandates under the Paris Principles can be applied, or where necessary strengthened, in order to promote and protect human rights as they relate to business, including through: • monitoring states’ and non-state actors’, including businesses’ compliance with human rights • advising all relevant actors on how to prevent and remedy such abuses • providing and/or facilitating access to judicial and/or non-judicial remedies, for example by supporting victims, handling complaints and/or undertaking mediation and conciliation • conducting research and undertaking education, promotion and awareness-raising activities • integrating human rights and business issues when interacting with international human rights bodies, including UN treaty bodies, Special Procedures, the Human Rights Council and the Universal Periodic Review, as well as regional human rights mechanisms. 17. To broaden NHRIs’ activities by means such as: • creating focal points on business and human rights within their institutions and developing platforms to convene dialogue among relevant actors • engaging with organisations and stakeholders at national, regional and international levels, such as business, including small and medium sized enterprises (SMEs), trade unions, civil society and the UN Global Compact • supporting victims of corporate abuses, and facilitating their access to effective judicial and non-judicial remedies • empowering human rights defenders and securing the effective participation of civil society in business and human rights, in particular vulnerable groups. 21.

Ensuring that those most affected by development and environmental policies are able to obtain information, freely express their views and participate in the decision-making process not only promotes human dignity, equality and freedom, the benefits of implementing all human rights; it also improves the effectiveness of policymaking by ensuring that the policies benefit those who are most affected by them. 25. (...) For mining to be in accordance with human rights obligations, it must be carried out only after prior assessment and consultation with the people most affected. Effective remedies must be provided for violations of their rights.

States Members of the United Nations have therefore been very much left to “do their own thing” when it comes to safeguards and remedies in the case of State-led surveillance. The United States’ approach to the subject reflects a genuine concern to get to grips with the thorny problem of effective oversight of surveillance. (...) The concept of “police intelligence” is not a new one and there may be an understandable necessity to have such a standing function, but in that case, it is recommendable that the safeguards and remedies at state level should be at least as strong had the same activity been carried out by an intelligence agency or other agency operating at the federal level. (...) If instances are detected where surveillance was either unnecessary or disproportionate, if the right safeguards and/or remedies were not in place (e.g., ex ante authorization on an ad hoc basis), then they should be legislated into being and deployed without delay.
