She has received reports that trafficked persons are frequently left without either substantive remedies or the support necessary to access such remedies and, as a result, are often exposed to further human rights violations and the risk of being re-trafficked. 5. Another conceptual issue that was seen as contributing to the lack of clarity was the relationship between remedies and access to justice, with some participants arguing that the former was subsumed into the latter. (...) It also demonstrated the importance of regularizing residence status, not only for the purpose of seeking remedies, but in some cases as a remedy in itself.

(e) What sanctions and other remedies can be ordered following a finding of corporate legal liability for adverse human rights impacts of business activities? (...) Another term for such remedies is “punitive remedies”. The primary goal of “compensatory remedies”, on the other hand, is to compensate a victim for the loss or harm suffered. (...) It highlights the importance of appropriate consultation with victims to ensure that their needs are adequately taken into account in the design of sanctions and other remedies (11.3). In addition, it highlights the need for appropriate monitoring of implementation of both punitive and compensatory remedies (11.4).

A/HRC/11/13/Add.1 page 16 complemented by judicial remedies”.29 Administrative remedies may thus be “adequate”, provided there is an opportunity for judicial review.30 Whatever remedy is provided, the Committee has stressed that it should be provided in an accessible, affordable, timely, and effective manner. 25. (...) They should be empowered to provide effective remedies, such as compensation, reparation, restitution, rehabilitation, guarantees of non-repetition, declarations, public apologies, educational programmes and prevention programmes (...) Both civil and criminal proceedings may be relevant but the Committee has made clear its view that the Convention does not require a system of “sequential remedies”, which must be followed in all cases. Rather, it has recommended that remedies must be provided within a reasonable time.42 34.

Human rights defenders are particularly vulnerable to the failure to provide effective domestic remedies; see Commission resolution 2005/67 on human rights defenders, especially paragraphs 7 and 8, and document E/CN.4/2005/101. 6 On the subsidiary nature of international scrutiny, see e.g. (...) There is no obligation to exhaust ineffective remedies, which includes those that are unduly protracted. Where the Government asserts that domestic remedies exist and are effective, it is necessary for the applicant to establish their ineffectiveness.
