REPORT OF THE SPECIAL RAPPORTEUR ON TRAFFICKING IN PERSONS, ESPECIALLY WOMEN AND CHILDREN, JOY NGOZI EZEILO : ADDENDUM
She has received reports that trafficked persons are frequently left without either substantive remedies or the support necessary to access such remedies and, as a result, are often exposed to further human rights violations and the risk of being re-trafficked. 5. (...) It also demonstrated the importance of regularizing residence status, not only for the purpose of seeking remedies, but in some cases as a remedy in itself. (...) Severe challenges in the enforcement of remedies risk having a demoralizing effect on both trafficked persons and practitioners, to the extent that it is sometimes considered that informing trafficked persons of available remedies amounts to instilling a false hope. 58.

REPORT OF THE SPECIAL REPRESENTATIVE OF THE SECRETARY-GENERAL ON THE ISSUE OF HUMAN RIGHTS AND TRANSNATIONAL CORPORATIONS AND OTHER BUSINESS ENTERPRISES : ADDENDUM
Participants discussed practical impediments to victims seeking remedies in home States, such as facilitating travel by witnesses, finding advocates and raising funds. (...) Avoiding restrictions on remedies 72. There was a suggestion that one should not assume that home States are the best forum for a remedy. (...) However, there was also a sense that home States might have a role to play where remedies in the territorial State are unlikely to be effective.

WORKING PAPER ON THE IMPLEMENTATION IN DOMESTIC LAW OF THE RIGHT TO AN EFFECTIVE REMEDY / BY FRANCOISE HAMPSON
Human rights defenders are particularly vulnerable to the failure to provide effective domestic remedies; see Commission resolution 2005/67 on human rights defenders, especially paragraphs 7 and 8, and document E/CN.4/2005/101. 6 On the subsidiary nature of international scrutiny, see e.g. (...) There is no obligation to exhaust ineffective remedies, which includes those that are unduly protracted. Where the Government asserts that domestic remedies exist and are effective, it is necessary for the applicant to establish their ineffectiveness.

VISIT TO GEORGIA : REPORT OF THE WORKING GROUP ON THE ISSUE OF HUMAN RIGHTS AND TRANSNATIONAL CORPORATIONS AND OTHER BUSINESS ENTERPRISES
Concerns were also raised regarding the lack of effective penalties or remedies for arbitrarily dismissed employees, including lengthy delays involving labour rights in legal disputes. (...) The absence of adequate legal protection is compounded by the lack of official statistics on migrant workers, which makes it difficult to assess the specific challenges they face and the actions required to protect them from abuse, and to provide effective remedies. The Working Group encourages Georgia to ratify the relevant international human rights instruments, including the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families, the ILO Migration for Employment Convention (Revised), 1949 (No. 97) and the ILO Migrant Workers (Supplementary Provisions) Convention, 1975 (No. 143).
