On 16 July 2022, the Applicant’s Counsel wrote an email to the Registry staff indicating that the time allocated (deadline of 19 July 2022) was such an extremely short period within which to research, prepare and file the submissions, considering the weighty issues raised in their client’s application.

Alessandro Calvani, Director of the United Nations Interregional Crime and Justice Research Institute (UNICRI), that the United Nations Office of Internal Oversight Services (OIOS) would “be initiating an investigation into the findings set out in” an audit report issued on 2 December 2009, entitled Comprehensive audit of [UNICRI] – Poor governance and non-compliance with United Nations regulations and rules tainted significant areas of UNICRI’s activities, and that the Applicant was placed on administrative leave without pay “for an initial period of three months, or until such time as the investigation is completed, and a decision is taken on whether or not to pursue the matter further, whichever is earlier”; 2.

The Applicant is serving as a Project Manager, P-4, for the Drug Research Center, United Nations Office on Drugs and Crime (UNODC).

The SAC minutes include a list and descriptions of the educational qualifications that the Applicant claimed in his curriculum vitae to have obtained which included: (i) a Bachelor’s degree in behavioral science and a minor in counseling and group therapy; (ii) an advanced certificate in legal research; (iii) a diploma in legal research; (iv) a certificate in counseling and (v) training in peer education and counseling. (...) The CV states that between June 1990 and 1992, the Applicant studied at the Southern Institute of Florida and obtained a degree in Advanced Legal Research; in May 1992, he obtained a degree in Social Science from Ulster Community College, New York; in May 1994, he obtained a Legal Research Diploma from Albany Legal Research, New York and in May 1997, he then added a Bachelor’s degree in Behavioral Science with a Minor in Psychology in Counseling and Group Therapy from Mercy College, New York, USA to his academic achievements. 37. (...) Gibson put it to the Applicant during their meeting that the Albany Legal Research and Southern Florida Institute which he claimed to have obtained certificates from were fictitious colleges and did not exist, the Applicant said he studied at those institutions by correspondence and that he had the certificates in his luggage.

The Applicant joined the World Meteorological Organization (“WMO”) Secretariat in August 2011 to work for the World Climate Research Program (“WCRP”), as a P-5 Senior Scientific Officer under a two-year fixed-term appointment (“FTA”).

By application filed on 26 March 2018, the Applicant contests: a. the recruitment and selection process for the post of Corporate Alliance Manager for Research (P-4), United Nations Children’s Fund (“UNICEF”); and b. the decision to place her under the direct supervision of a P-3 “who has no supervisory functions in her Terms of Reference”. 2.

Powell submits that his counsel had just returned from a mission when he discovered his oversight and “[i]n his haste to file the [answer] and request for suspension, waiver or extension as soon as practicable”, he did not have the time to fully research relevant jurisprudence of the Appeals Tribunal or to consult his colleagues.

Lee states: I have been working on this case over the past year on nights and weekends doing research and preparing responses. The accumulation of stress and the lack of sleep over the decision and this case … have led to a recent series of anxiety attacks.… I am also of the understanding that it is difficult to file additional pleadings after the initial submission and given that my case involved four separate submissions to the management evaluation and several contested decisions, I want to be able to ensure that the appeals brief is comprehensive and properly prepared….
