Our existing criminal justice system should also be balanced with restorative justice, where we do not treat punitive punishment as the only effective means in changing the behaviours of the offenders, but involving all stakeholders of justice – the offenders, victims and the affected communities – in seeking truth, healing and reconciliation. It is time for all of us to stand up and be counted in the movement towards a restorative justice system that fairly punishes offenders and takes on the responsibility to repair the harm committed against victims, their families and communities.

.: General 11 May 2021 Resolution 2574 (2021) Adopted by the Security Council on 11 May 2021 The Security Council, Reaffirming its full commitment to the peace process in the Republic of Colombia, Recalling all its resolutions and statements of its President regarding the peace process in Colombia, Welcoming the progress made towards peace across Colombia since the adoption of the Final Agreement for Ending the Conflict and Building a Stable and Lasting Peace (the Final Agreement) and urging the parties, with the support of relevant state institutions and security forces, as well as civil society, to work together to sustain progress and address challenges, in particular the continued violence in conflict - affected areas, through comprehensive implementation of the Final Agreement, and recalling in this regard the five priorities for 2021 recommended by the Secretary - General in his report S/2020/1301, Recalling in particular its resolution 2366 (2017) which established the United Nations Verification Mission in Colombia (the Verification Mission) to verify implementation by the Government of Colombia and Revolutionary Armed Forces of Colombia (FARC-EP) of sections 3.2 and 3.4 of the Final Agreement as called for in section 6.3.3 of the Final Agreement, and recalling the positive role played by the Verification Mission in that regard, Acknowledging the letter dated 13 January 2021 from the President of Colombia, on behalf of the Government of Colombia and with the agreement of the party of the former FARC-EP (S/2021/147), requesting the addition to the mandate of the Verification Mission of the task of verifying compliance with the sentences of the Special Jurisdiction for Peace, as envisaged in the Final Agreement , and taking note of the coordinating role of the Office of the Presidential Counsellor for Stabilisation and Consolidation specified in the letter, Noting that, under the terms of the Final Agreement, the sentences of the Special Jurisdiction for Peace will have the overall aim of realising the rights of victims and S/2021/449 4/4 21-06273 consolidating peace, and will need to have the greatest restorative and reparative function in relation to the harm caused, Recognising the contribution the Verification Mission could make to building confidence in the Comprehensive System for Truth, Justice, Reparation and Non-Repetition established under the Final Agreement, which is integral to the success of the peace process and the fulfilment of the rights of the victims of the conflict, Having considered the Secretary-General’s letter to the President of the Security Council of 24 February 2021 (S/2021/186), 1.

REPORT OF THE WORKING GROUP ON ARBITRARY DETENTION : ADDENDUM
The provision allowing “alternative measures” instead of the criminal judicial process is the primary avenue by which provincial governments administer restorative justice programmes. The Supreme Court of Canada has defined restorative justice as an attempt to “(r)emedy the adverse effects of crime in a manner that addresses the needs of all parties involved. This is accomplished, in part, through rehabilitation of the offender, reparations to the victim and to the community, and the promotion of a sense of responsibility in the offender and acknowledgement of the harm done to the victim and the community”. Restorative justice approaches include sentencing circles, family group conferences, victim-offender reconciliation programmes, and victim-offender mediation. Some of the restorative justice programmes are derived from the traditional understanding and practice of justice of Canada’s Aboriginal communities, and are therefore particularly suited to carry out the mandate to pay special attention to the circumstances of Aboriginal offenders in section 718.2 (e).ii (c) Credit for pre-sentence custody 29.

In lieu of the proposed legislation lowering the MACR, the Commission recommends that the government fully implement RA 9344, as amended by RA 10630, by: e. allocating funds for building/restoring Bahay Pag Asa Facilities in every province and highly-urbanized cities; f. employing multi-disciplinary personnel that will provide individualized and efficient community-based and/or center-based interventions for CICLs, the victims and their families; g. continuously capacitating all professionals working with the juvenile justice system on relevant international standards and the JJWA; h. regularly visiting Bahay Pag-Asa Facilities and other youth homes to assess the operations and physical condition of these facilities and to monitor the human rights situation of the children detained therein; and i. popularizing, through information dissemination, the basic provisions of JJWA and restorative justice for better appreciation of the public. 14.

The Working Group was informed about the Nova Scotia Home for Coloured Children Restorative Inquiry, which is intended to address the history of institutionalized abuse of children and systemic and institutional racism.9 The Working Group welcomes the inquiry as a model of restorative justice based on collaborative examination and decision- making and encourages the province’s public agencies to engage as fully as possible in the process. The Working Group encourages the federal and provincial governments and agencies to adopt similar collaborative and restorative approaches in addressing similar issues affecting people of African descent in their jurisdictions.
