In lieu of the proposed legislation lowering the MACR, the Commission recommends that the government fully implement RA 9344, as amended by RA 10630, by: e. allocating funds for building/restoring Bahay Pag Asa Facilities in every province and highly-urbanized cities; f. employing multi-disciplinary personnel that will provide individualized and efficient community-based and/or center-based interventions for CICLs, the victims and their families; g. continuously capacitating all professionals working with the juvenile justice system on relevant international standards and the JJWA; h. regularly visiting Bahay Pag-Asa Facilities and other youth homes to assess the operations and physical condition of these facilities and to monitor the human rights situation of the children detained therein; and i. popularizing, through information dissemination, the basic provisions of JJWA and restorative justice for better appreciation of the public. 14.

The Special Rapporteur expresses his concerns at a presidential initiative aimed at restoring the death penalty for brutal offences of child sexual abuse, which if adopted would violate the State party’s international human rights obligations. 7. He firmly believes that combating corruption is paramount to generating indispensable public revenue and to restoring public trust in the ability of the State to hold perpetrators of malpractice into account. (...) During the visit, the Special Rapporteur heard repeated testimonies from civil society actors that mining licences had at times been granted despite public protests. Although restoring the confidence of investors is essential, it is equally vital to ensure economic growth is made sustainable, in order to benefit the society as a whole.

Subsequently, in May 2021, the Special Rapporteur transmitted official correspondence to all five States concerned, requesting concrete information on the easing of measures, including progress achieved under the bilateral mechanisms of negotiations to restore political, economic and social relations and envisaged mechanisms of redress. In this connection, the Special Rapporteur underlines that unilateral measures are only legal if: (a) they have a valid and clear legal basis in national legislation and do not breach the international obligations of States; (b) if they are authorized by the Security Council; or A/HRC/48/59/Add.1 GE.21-09193 7 (c) if their illegality is excluded in the course of countermeasures taken in accordance with the standards of international responsibility, with the purpose of restoring the observance of international obligations, prior notice and the criteria of legality, legitimacy and proportionality. 26.

They support the efforts of the government and people of the Islamic Republic of Afghanistan aimed at restoring peace, economic development of the country, countering terrorism, extremism and drug crime. (...) The Member States, in view of the importance of preserving environmental balance in the SCO space and restoring biodiversity for future generations, ensuring favourable conditions for the wellbeing of the people and for sustainable development, welcome the signing of the Action Plan on implementing the Concept of Cooperation in Environmental Protection.

SECURITY COUNCIL RESOLUTION 93 (1951) [ON CIVIL ADMINISTRATION IN VILLAGES AND SETTLEMENTS IN THE DEMILITARIZED ZONE ESTABLISHED BY THE ISRAEL-SYRIAN GENERAL ARMISTICE AGREEMENT]
II n'assumera pas la responsabilite d'administrer directement la zone»; Recalls to the Governments of Syria and Israel their obligations under Article 2, paragraph 4, of the Charter of the United Nations and their commitments under the Armistice Agreement not to resort to military force and finds that: (a) Aerial action taken by the forces of the Government of Israel on 5 April 1951, and (b) Any aggressive military action by either of the parties in or around the demilitarized zone, which further investigation by the Chief of Staff of the Truce Supervision Organization into the reports and complaints recently submitted to the Council may establish, constitute a violation of the cease-fire provision in Security Council resolution 54 (1948) and are inconsistent with the terms of the Armistice Agreement and the obligations assumed under the Charter; Noting tti,e complaint with regard to the evacuation of Arab residents from the demilitarized zone: (a) Decides that Arab civilians who have been removed from the demilitarized zone by the Government of Israel should be permitted to return forthwith to their homes and that the Mixed Armistice Commission should supervise their return and rehabilitation in a manner to be determined by the Commission; (b) Holds that no action involving the transfer of persons across international frontiers, across armistice lines or within the demilitarized zone should be under- taken without prior decision of the Chainpan of the Mixed Armistice Commission; Noting with concern the refusal on a number of occa- sions to permit observers and officials of the Truce Supervision Organization to enter localities and areas which were subjects of complaints in order to perform their legitimate functions, considers that the parties should permit such entry at all times whenever this is required io enable the Truce Supervision Organization to fulfil its functions, and should render every facility which may be requested by the Chairman of the Mixed Armistice · Commission for this purpose; Reminds. the parties of their obligations under the Charter of the United Nations to settle their international disputes by peaceful means in such manner that inter- national peace and security are not endangered, and expresses its concern at the failure of the Governments of Israel and Syria to achieve progress pursuant to their commitments under the Armistice Agreement to promote the return to permanent peace in Palestine; Directs the Chief of Staff of the Truce Supervision Organization to take the necessary steps to give effect to this resolution for the purpose of restoring peace in the area, and authorizes him to take such measures to restore peace in the area and to make such representations to the Governments of Israel and Syria as he may deem necessary; Calls upon the Chief of Staff of the Truce Supervision 9 Rappe/le aux Gouvernements de la Syrie et d'Israel leurs obligations aux termes du paragraphe 4 de l 'Article 2 de la Charte des Nations Unies et }'engagement qu'ils ont pris aux termes de la Convention d 'armistice de ne point recourir a la force militaire, et constate que: a) L'action aerienne menee par des forces du Gouver- nement d 'Israel, le 5 avril 1951, et b) Toute action militaire agressive, menee par l'une ou l'autre des parties a l'interieur ou sur le pourtour de la zone demilitarisee, que viendrait a etablir une enquete ulterieure du Chef d'etat-major de l'Orga- nisme charge de la surveillance de la treve sur Jes plaintes et rapports recemment sournis au Conseil, constituent une violation de l'ordre de cesser le feu donne par la resolution 54 (1948) du Conseil de securite et soot incompatibles avec les termes de la Convention d'armis- tice et les obligations imposees par la Charte a chacun des Etats Membres; Prenant acte de la plainte relative a }'evacuation des residents arabes de la zone demilitarisee: a) Decide que les civils arabes qui ont ete evacues de la zone dernilitarisee par le Gouvernement d 'Israel doivent etre autorises a rentrer immediatement dans leurs foyers et que la Commission mixte d'armistice doit surveiller leur retour et leur installation dans les conditions qu'elle-meme determinera; b) Tient qu'aucune action impliquant transfert de personnes au-dela des frontieres internationales, des lignes d 'armistice, ou a l 'interieur de la zone demilitarisee, ne doit etre entreprise sans decision prealable du President de la Commission mixte d'armistice; Prenant acte avec souci du refus en de nombreuses occasions de permettre a des observateurs ou a des membres de l'Organisme charge de la surveillance de la treve l'acces, pour l'exercice de leurs fonctions legitimes, de localites ou de zones visees dans des plaintes, estime que les parties doivent donner cet acces toutes les fois qu'il est requis pour permettre a l'Organisme charge de la surveillance de la treve d'exercer ses fonctions, et fournir toutes facilites qui seraient demandees dans ce but par le President de la Commission mixte d'armistice; Rappe/le aux parties qu'elles sont obligees, aux termes de la Charte des Nations Unies, de regler leurs differends internationaux par des moyens pacifiques, de telle maniere que la paix et la securite internationales ne soient pas mises en peril, et exprime la preoccupation que lui cause le manquement des Gouvernements d 'Israel et de la Syrie a effectuer des progres vers la realisation de l'engagement qu'ils ont pris en signant la Convention d 'armistice de promouvoir le retour d 'une paix permanente en Palestine; Donne instruction au Chef d'etat-major de l'Organisme charge de la surveillance de la treve de prendre les mesures necessaires pour donner effet a la presente resolution afin de restaurer la paix dans la zone consideree, et l'autorise a prendre telles mesures pour restaurer la paix dans cette zone et a faire aux Gouvernements d'Israel et de la Syrie telles representations qu'il estimerait necessaires; Demande au Chef d'etat-major de J'Organisme charge Organization to report to the Security Council on compliance given to the present resolution; Requests the Secretary-General to furnish such addi- tional personnel and assistance as the Chief of Staff of the Truce Supervision Organization may request in carrying out the present resolution and Council resolu- tions 92 (1951) and 89 (1950).
