Selection and appointment of the governing body: The Sub-Committee notes the critical importance of the selection and appointment process of the governing body in ensuring the pluralism and independence of the National Institution. In particular, the Sub-Committee emphasizes the following factors: (a) A transparent process; (b) Broad consultation throughout the selection and appointment process; (c) Advertising vacancies broadly; (d) Maximizing the number of potential candidates from a wide range of societal groups; (e) Selecting members to serve in their own individual capacity rather than on behalf of the organization they represent. 5.

The secretariat shall compose the members of a TTE from the UNFCCC roster of experts maintained by the secretariat to conduct technical analysis of biennial update reports in such a way that: (a) Allows the collective skills of each team to address the areas of information defined in decision 2/CP.17, annex IV, paragraph 3(a); (b) Achieves a balance between experts from Parties included in Annex I to the Convention (Annex I Parties) and non-Annex I Parties in the overall composition of the team, without compromising the selection criteria referred to in paragraph 1 above; (c) Ensures geographical balance among the experts selected from non-Annex I Parties and Annex I Parties; (d) Ensures that each TTE is co-led by two experts: one from an Annex I Party and another from a non-Annex I Party.

In determining the maximum amount of futures sales in a given year, the Trustee will incorporate the objective of keeping a cash inventory in the AF Trust Fund cash account commensurate with the expected disbursements of the AF throughout the year; (d) Selection of exchanges based on their strength, reputation and liquidity. 18. However, a number of concerns relating to the lack of sufficient structural safeguards for the independence of the judiciary and the courts remain. Selection and appointment 35. During her visit, the Special Rapporteur spoke with many individuals who expressed concern about the selection and appointment of judges, in particular the lack of transparency of the procedures and the important role played by the President, which opens the door to political manipulation and interference. (...) Those opportunities should be provided on the grounds of objective criteria, including to junior judges, ensuring a consistent and transparent selection of candidates for specific training sessions. 46. (...) The Attorney-General acts both as the chief legal adviser of the Government and the head public prosecutor; he or she is appointed by the President upon approval by the Constitutional Council.9 As the Council has not yet published its rules of procedure and evaluation criteria, the selection and appointment procedure lacks transparency.

The Special Rapporteur notes that the effectiveness of the Judicial Training Centre is undermined to some extent by a lack of human and material resources. Selection 43. Until 2004, the selection of lower court judges was governed by the Law on the Attestation Procedure of Judges of the Local Courts of 28 September 1999. (...) The recently established National Council of Justice has taken over the selection procedure. Competitive examinations for vacant posts of judges are publicly announced. (...) The reappointment and advancement system is similar to the selection and appointment procedure. Lower court judges are required to undergo another attestation procedure for reappointment to the lower or higher level courts.
