The procedure envisaged by the Law with regard to the selection of candidates is extremely cumbersome. In the opinion of the Special Rapporteur, the selection procedure could be made more straightforward by organizing regular competitive selection processes and appointing successful candidates on the basis of their rating in that process. L’article 19 prévoit que: Le Comité de sélection des candidats Commissaires est composé de cinq (5) membres provenant: 1. des organisations non gouvernementales œuvrant pour la promotion et la protection des droits de la personne; 2. de la Commission de la Fonction Publique; 3. de la Société Civile; 4. d'autres experts justifiant d'une expertise et des connaissances en matière des droits de la personne. Un Arrêté Présidentiel nomme les membres du Comité de sélection des candidats. L’Arrêté Présidentiel n° 72/01 de la 12/03/2014 portante création du Comité de sélection A/HRC/26/NI/4 4 GE.14-04281 des candidats Commissaires à la Commission Nationale des Droits de la Personne est venu renforcer cette transparence voire le respect de la diversité dans la nomination des Commissaires.
