The selection of justices of the Supreme Court is a two-step process. (...) The participants recommended that a specific legal mechanism should be defined in
the short term for each step of the selection process, with precise, motivated selection
criteria and on the basis of the profile of the civil servant sought, and that transparent
selection processes with public participation should be introduced. (...) Its purpose is to establish a ranking within the judicial service so as to be able
to select persons for promotion and implement a selection system based on a competitive
examination, beginning with magistrates’ courts.

VISIT TO HONDURAS : REPORT OF THE SPECIAL RAPPORTEUR ON THE INDEPENDENCE OF JUDGES AND LAWYERS
The Special Rapporteur stresses that the procedure followed for the selection and
appointment of candidates to the national anti-corruption jurisdiction in 2016 represents a
good practice that could be used in the future for the selection and appointment of all judges.
The selection process was carried out in accordance with a selection protocol adopted by the
judicial branch, which indicated the requirements that candidates had to meet and the
modalities for setting up the commission for the selection of candidates. (...) According to some
interlocutors, the elaboration of those rules represents a good practice that could be followed
for future selection processes. Nevertheless, he notes with concern that that selection process
fell short of international standards in several aspects.

concerned that the lack of appropriate selection criteria and procedures facilitates
interference from political parties and economic groups in the selection process.

selection. The pre-selection aims at preparing the list of candidates that the National

The Sub-Committee (“SCA”) notes the following:
While the NHRC considers and proposes new members, the existing legislative
process refers to the selection of new members by the Emir. The existing legislation
should establish a clear, transparent and pluralistic nomination process. The SCA
refers to General Observation 2.1 “Ensuring pluralism” and General Observation 2.2
“Selection and appointment of the governing body”.
There is no legislative provision guaranteeing the immunity of NHRC members for
actions undertaken in their official capacity. (...) The SCA refers to General Observation 2.2
“Selection and appointment of the governing body” and emphasizes the importance
that the selection and appointment process involves; a transparent process; broad
consultation through the selection and appointment process; advertising vacancies
broadly; maximizing the number of potential candidates from a wide range of
societal groups; and selecting members to serve in their own individual capacity
rather than on behalf of the organization they represent

4) The Sub-Committee encourages the Commission to interact effectively with the
United Nations Human Rights system, especially the Treaty Bodies and the
following up of the recommendations at the national level, in line with General
Observation “Interaction with the International Human Rights System”.

General Observation “Selection and appointment of the governing body”.
2) With regard to the appointment, the Sub-Committee notes the short term of office of
the members of the commission (two years). (...) The Sub-Committee notes the following:
1) It refers to the General Observation “Selection and appointment of the governing
body”, in particular to the importance of having in the founding legal documents a
broad and formal consultation process in the selection and appointment of members.
2) It also refers to General Observation “Guarantee of tenure for members of governing
bodies” to highlight the need to entrench transparent and objective criteria for the
dismissal of the Commission members in the founding legal documents.
3) It further refers to General Observation “Staffing by secondment” to highlight the
importance of amending the legislation to allow the Commission to recruit its own
staff.
