selection processes with public participation should be introduced. (...) Its purpose is to establish a ranking within the judicial service so as to be able
to select persons for promotion and implement a selection system based on a competitive
examination, beginning with magistrates’ courts.

The procedure envisaged by the Law with regard to the selection of candidates is
extremely cumbersome. In the opinion of the Special Rapporteur, the selection procedure
could be made more straightforward by organizing regular competitive selection processes
and appointing successful candidates on the basis of their rating in that process.
Competitive examinations conducted, at least partly, in a written and anonymous manner
represent an important tool in the selection process.13 Mandatory training, including an
internship in court, could be provided only to candidates who had been successful in the
selection process.

The Special Rapporteur stresses that the procedure followed for the selection and
appointment of candidates to the national anti-corruption jurisdiction in 2016 represents a
good practice that could be used in the future for the selection and appointment of all
judges. The selection process was carried out in accordance with a selection protocol
adopted by the judicial branch, which indicated the requirements that candidates had to
meet and the modalities for setting up the commission for the selection of candidates. (...) According to some
interlocutors, the elaboration of those rules represents a good practice that could be
followed for future selection processes. Nevertheless, he notes with concern that that
selection process fell short of international standards in several aspects.

CURRENT LEVELS OF REPRESENTATION OF WOMEN IN HUMAN RIGHTS ORGANS AND MECHANISMS :ENSURING GENDER BALANCE : REPORT OF THE HUMAN RIGHTS COUNCIL ADVISORY COMMITTEE
This Annex focuses on the United Nations human rights bodies and mechanisms that
are the subject of the present report, in particular to: (i) describe their function; composition;
nomination and election processes; selection criteria; and term of membership; and (ii)
present data on their current and historic levels of gender representation. (...) Elections for UN treaty bodies take place during meetings of States parties of each
treaty body, and experts are elected by secret ballot.12 The elected nominees are those “who
obtained the largest number of votes and an absolute majority of the votes of the
representatives of States parties present and voting”.13
8. Selection criteria: Pursuant to the General Assembly resolution 68/268, States are
encouraged to give due consideration to “balanced gender representation”, as well as other
factors such as “equitable geographical distribution” and “the participation of experts with
disabilities” when nominating and electing independent experts for UN treaty bodies. 14
Resolution 68/268 also reiterates the importance of equitable gender representation within
the composition of UN treaty bodies, as stipulated in the human rights instruments.15
9. In addition, all treaties specifically provide that equitable geographical distribution
and representation of different legal systems be considered in the selection of the experts,16
as well as their qualifications in the form of high moral standing, impartiality, and
competence.
