While international law permits parties to the conflict to legitimately detain certain individuals, there is a strict prohibition on extrajudicial executions and torturing detainees. (...) While there were moments of calm after 2001, the period from 2006 onwards saw a dramatic increase in insurgency attacks. Human Rights Watch estimates that insurgent attacks left 1,000 civilians dead and wounded in 2006. (...) Shootings, assassinations, or ambushes killed another 177 civilians. Human Rights Watch also reported that bombing and arson attacks on Afghan schools doubled, from 91 reported attacks in 2005 to 190 attacks in A/HRC/11/NI/6 page 6 2006.

One such project that has been of concern to the Special Rapporteur is the Mapithel Dam in Manipur.38 In 2009, the Special Rapporteur on the rights of indigenous peoples urged the Government to seek free, prior and informed consent of indigenous peoples, followed by a call to ensure that the rehabilitation and resettlement of the villagers concerned be pursued only insofar as a strict and detailed human rights impact assessment was undertaken. 50.

In view of the strict word limit of country reports, the Special Rapporteur will not be able to present a complete and exhaustive picture of the situation of religions and beliefs in the United Kingdom or to provide a thorough analysis of all questions related to religion or belief. Under the common law in England and Wales it is a strict liability offence to utter or publish blasphemous words and writings, but the scope of that offence has been narrowed in the last 150 years.

Some interlocutors pointed out, however, that strict laws and procedures are in place for organ donation and transplantation, according to which a donor must obtain authorization from the President of a court or a nominated judge, in presence of two medical practitioners nominated by the national commission for medical practitioners. (...) The authorities informed the Special Rapporteur that strict regulations were in place to control organ removal. (...) There is also a toll-free telephone hotline for victims of violence run by non-governmental organizations, such as the National Watch of Children’s Rights. Shelters and protection centres still remain in short supply.

According to Human Rights Watch (HRW), the discrepancies are due to the varying definitions of what it means to be “indigenous”. (...) Before the civil war, it was rare to find women heading households due to a strict machista gender order that assigned to men the roles of provider and to women, caring and nurturing roles. (...) Women are reportedly subjected to physical, sexual and psychological violence. Human Rights Watch (HRW) reports widespread gender-based discrimination, including inquiries about employees’ reproductive status, post-hire penalization of pregnant workers, and failure to enforce maternity protections.

The previous law had been criticized for giving the overseeing agency broad discretionary powers over organizations, for imposing strict budgetary limitations on charities which prohibited them from receiving more than 10 per cent of their funding from foreign sources, and for imposing criminal penalties for failing to comply with certain provisions. (...) The Special Rapporteur refers to Human Rights Committee general comment No. 36 (2018) on the right to life, in which the Committee made it clear that any such sanctions could only be imposed for the most serious crimes, and that they must be read restrictively and be subject to a number of strict conditions, notably respect for the fair trial guarantees provided for in article 14 of the International Covenant on Civil and Political Rights.

In relation to penalties for filming law enforcement agents, the Special Rapporteur was advised that the State Secretariat for Security had issued, in October 2018, strict instructions that filming or taking a photo of law enforcement officials was not an infraction as such. While the Special Rapporteur commends Spanish authorities for these clarifications, he notes that the legislation still in force could be seen to contradict the proposed strict interpretation, and that the practice of law enforcement agents in the field in 2019 did not seem to fully comply with the instructions. 35.
