It is to: ‘(a) Chair the Peace Process Consultative Committee, which will consult with the parties on the pace process in general, and make prepamtiom for. elections, in pdW, (b) Report on the security and the subsequent destruction of the contained weapons; 1 (c) Monitor the constitutional process leading to the adoption of the Bougainville Constitution; (d) In accordance with the amended Constihlton of Papua New Guinea, and if requested by any of the parties, verify and certify substantial compliance by the parties in the .handing in of weapons and whether the level of Security is conducive to the boldihg of elections; Perform other good offices, as appropriate, or when requested to do so by the parties.’ (...) (2) Elections to the Baugainville Legislature may be held only - (a) in accordance with an agrcemcnt reached in accordance with Paragraph 8 (a) of the weapons disposal plan contained in the pougainville Peace] Agreement; or on verification and certification by the Director of the United Nations Observer Mission in BougainviLle, of substantial compliance with, and generally in accordance with Paragraph 8(b) of, the weapons disposal plan according to the lJ3ougainvillo Pcace‘J Agreement’ @) N: Paragraph 8 of the agreed weapons disposal plan is s ,eel in Paragraph 6 above; the original text of relevant sections in this and other sections of the plan are annexed for information. The Constitution of Kenya 2010 provides that every accused person has the right to receive the assistance of an advocate at the State’s expense “if substantial injustice would otherwise result” (Section 50(2) (h)). It is clear that a substantial injustice results when an accused person is convicted and sentenced to death without having the opportunity to put forward an adequate defense with the assistance of a trained advocate.
