To justify higher prices, companies have to develop a product superior to the current regimen, which is scientifically difficult. (...) Additionally, because tuberculosis is a disease affecting mostly developing countries, it is assumed that the bulk of drug purchasers are not wealthy enough to afford the cost of treatment. Companies deterred from investing in anti-tuberculosis drug research postulate that if most individuals cannot afford the expense of existing treatment today, they could ill afford the cost of superior and more expensive treatment tomorrow. (...) In order to command premium prices that would make tuberculosis research more financially attractive, pharmaceutical companies would need to develop a drug superior to what already exists.

The Superior Tribunal de Justiça also held that Inepar had assumed all the obligations of the acquired companies and had fully presented its case before the Tribunal, thus, no violation of due process had occurred. Subsequently, an award was rendered in Korea and the Claimant, a different Brazilian company, requested recognition and enforcement (“homologação”) of the foreign award before the Superior Tribunal de Justiça (Superior Court of Justice).

Mr President, Today's panel discussion is prompted by the General Assembly's resolution 73/262, which expresses alarm at the rise of movements based on racist and extremist ideologies spreading notions of racial superiority, and fuelling racism and xenophobia. The resolution proclaims that all human beings are born free and equal in dignity and rights; that all have the potential to contribute constructively to the development and well-being of their societies; and that "any doctrine of racial superiority is scientifically false, morally condemnable, socially unjust and dangerous and must be rejected." (...) Mr President, Ideas of racial superiority and racial supremacy have driven wars, oppression, exploitation and horrific suffering. (...) We need to openly condemn all messages – especially political messages or discourses – which disseminate ideas based on racial superiority or hatred, or which incite racism, racial discrimination, xenophobia and related intolerance.
