By email of 25 September 2007, the Chief of Recruitment and Outreach, FPD/DFS, concluded that his Graduate Certificate from Charles Darwin University did not constitute a first-level university degree. On the same date, the Applicant responded that his Graduate Certificate from Charles Darwin University “is in fact a postgraduate degree as [the University] accepted [his] application in their graduate programme based on prior learning and work experience. El Madhoun had been unlawfully excluded from the short-list of candidates for not possessing a university degree when the Agency had improperly applied the criteria described in its vacancy announcement, namely that a “university degree or equivalent experience” was required. Certification and clarification regarding the equivalence of qualifications to a university degree must however be undertaken by the relevant authorized institution in charge of Higher Education Programs or an accredited University or College. 18.
