This Order was published on the [Dispute] Tribunal’s website under the section “President’s Orders”. … In reply to his request for management evaluation, [Mr. (...) Gehr has not established any irregularity in such decision. Given that the UNDT website has published numerous UNDT orders on requests for recusal, Mr. (...) Gehr’s motion for recusal in the “President’s Orders” section of that Tribunal’s website did not constitute an appealable administrative decision. 13.

On 5 November 2020, the Applicant filed a motion to restrict access to case records by which he requests that the Tribunal (a) “determine the existing Orders in this case to be confidential and direct their removal from the Tribunal’s website; and (b) “determine ex ante that the Judgment in this case is confidential and direct that it not be published on the Tribunal’s website”. As background for this motion, the Applicant explains the following: … Shortly after the hearing concluded, a story regarding the case appeared on Inter City Press, a website run by Mr Matthew Lee, under the following headline: ‘In UN Beer Party Staffer [the Applicant] Forced Himself On SL Accenture Contractor As Press Banned’. (...) All orders in the present case are to be removed from the Dispute Tribunal’s website. 7. The name of the Applicant will be anonymized in the forthcoming judgment in this case.

Pages that appear from pop-ups usually point to a generic homepage of the website or a page designed to advertise a website. (...) Entries 7196 – 7287 starting on page 699 of the agreed bundle, once again show the browsing of a website using a keyword search. This was not a pornographic website but a generic one that hosts videos usually uploaded by users. (...) Entry 9683 on page 708 shows an attempt to register with a website “citysex.com”. The email used to register on the website was kramojl@yahoo.fr.

Please note that the UNDT website instructs/permits filing by email attachment (emphasis in original). (...) The Tribunal has taken note of the instruction on the website of the Office of Administration of Justice, which Counsel has gone to great lengths to quote in her email of 13 January 2016. 5. (...) The operative word in the website instruction is “unable”, which connotes that a party has at least made an attempt to file a submission via CCMS but failed to do so due to incapacity, a technical problem or the inexistence of technological facilities at his/her location.

The Applicant also seeks the redaction of her “identity from all the documents which are publicly available on the [Dispute Tribunal’s] website, including [Judgment] on Suspension of Action [in Case No.] (...) Written requests to this effect should be submitted through the Registrar using the generic form available on the Tribunal’s website, or some other means acceptable to the Registrar (...) Cognizant of the risk of not reaching all eligible participants, however, it specifically noted, both in its 2007 annual letter and in the website link that it could not guarantee that it would be able to reach everyone who was eligible. It posted the amended Regulations on its website; it highlighted the changes in its 2007 annual letter; and it posted a dedicated link on its website, which clearly set out the changes to Article 24(a) and the relevant deadline. The information was easily accessible on the website. 29. Ideally, it might have been better if each potentially affected participant was personally informed of the amendment.

The Applicant considers that any reference to this case on the United Nations website, which is publicly accessible, would impose an unjustified additional punishment on him and his family due to the particular circumstances of his case.
