UNIVERSAL PERIODIC REVIEW : INFORMATION PRESENTED BY THE HUMAN RIGHTS COMMISSION OF MALAYSIA (SUHAKAM) : NOTE / BY THE SECRETARIAT
It is the Commission’s hope that the proposed Gender Equality Act would be drafted based on broad consultation with relevant stakeholders and is in compliance with fundament human rights principles, particularly CEDAW. 2.4 Noting the Government’s initiative in addressing sexual harassment issues at the workplace, the Commission recommends the Government to: • consider the enactment of an effective legislation on sexual harassment; • review the Employment Act 1955, in particular, its scope of application and protective measures in tackling sexual harassment issues. (...) • implement effective training and rehabilitation programmes to prevent occur- rence of sexual harassment in the workplace. 2.5 In respect of child rights, the Commission welcomes the Government for the positive moves it has made.

The municipal human rights commission has competence over any alleged infringements by the city government, district offices and city-sponsored welfare facilities, and serves not just registered residents of the city, but anyone who officially has a workplace in Seoul. Petitions to the commission can be filed by victims and people who have knowledge of alleged violations. (...) Although EPS recognizes migrant workers as workers under labour law, it places a number of restrictions on them, for example with regard to the number of times they can change workplace and employment and the maximum period of stay, denies them the right to family reunification and places extreme burdens on migrants seeking to change the type of visa. (...) Such a change in employment would not be included in the total number of workplace changes permitted during the worker’s employment in the Republic of Korea.

The lesbian, gay, bisexual, transgender and intersex community is also facing escalating violence; the Special Rapporteur was informed that 107 members of this community were murdered between 1994 and October 2012 in the departments of Francisco Morazán, Cortés, Atlántida, Islas de la Bahía, Choluteca, Comayagua, Olancho and El Paraíso.14 Lesbians and other women who live outside of heterosexual norms are often subjected to violence, rape and other forms of discrimination. In the workplace they are often bullied, harassed or overlooked for promotions, and may even be denied employment due to their style of dress.15 The Special Rapporteur was informed of an increasing trend of migration, especially among transgender sex workers seeking to flee from discrimination and abuse. 18.
