We state that a number of terms and concepts used in these documents cannot be considered generally accepted. (...) We note that our country at the government level does not support the so-called “harm reduction strategy” associated with this practice. We consider it wrong to include such data in the UN document. We confirm our position on the unacceptability of a number of provisions of the Asian and Pacific Ministerial Declaration on Population and Development of 2013, which had been adopted by vote and which was the focus of the last year’s regional review for the Asia-Pacific Region.

We, therefore, hold that it would be premature to develop a conclusion on this issue. Although the concept does exist in international theory, the “differing views” on the topic, to which para. 4 of the commentary refers to, is an issue that merits elaboration, given its implications on the very authority of the principle. Further, the issue of the inapplicability of the concept not just to jus cogens but also to other kind of rules of fundamental importance, is another aspect that needs to be further reflected upon in the framework of this work, given also the significant amount of support to this end. At any rate, a state invoking the persistent objector concept shall be under a duty to present solid evidence of its long-standing and constant opposition to the rule under concern in any given case prior to its crystallization.

"Countermeasures" 5.36 Dictionary definitions of "countermeasure" suggest that a countermeasure is essentially defined by reference to the wrongful action to which it is intended to respond. (...) This use of the term is in line with its ordinary dictionary meaning as described above: these measures are authorized to counteract, in this context, a wrongful action in the form of an export subsidy that is prohibited per se, or the effects thereof. 5.38 It would be consistent with a reading of the plain meaning of the concept of countermeasure to say that it can be directed either at countering the measure at issue (in this case, at effectively neutralizing the export subsidy) or at counteracting its effects on the affected party, or both. 5.39 We need, however, to broaden our textual analysis in order to see whether we can find more precision in how countermeasures are to be construed in this context. The term "disproportionate" thus suggests a lack of proper or due relationship between two elements. 5.50 Based on the ordinary meaning of the terms, the concept involved is understood well enough in everyday experience.

As rightly pointed out by the Special Rapporteur, precisely this second factor (devolution of an organ as well as responsibility for internationally wrongful acts), seems also to be recognized by the International Court of Justice as a part of its “jurisdiction construct" in the case between Croatia and Serbia on the application of the Genocide Convention. Finally, as regards the issue of succession of responsibility, let me add that, in the light of the above, it is obvious that when analysing different forms of succession of state responsibility, one should also pay attention to (not so unlikely situation) in which part or parts of the predecessor state that become successor states, could bear responsibility for internationally wrongful acts not only towards third states, but also towards other successor states of the once common state. (...) We commented on this important issue in a number of occasions, in particular elaborating on the basic elements (nature, scope and limits) as well as a proper implementation (procedural safeguards) of this noble concept, cautioning thus against its misuse. In that context, Croatia particularly highlighted the point that universal jurisdiction is a jurisdictional basis of last resort.

The transatlantic trade in enslaved Africans was instrumental in shaping modern conceptions of race.  To rationalize the inhumanity of the slave trade, Africans were portrayed as less than human.  (...) We must reverse the consequences of generations of exploitation, exclusion and discrimination — including their obvious social and economic dimensions through reparatory justice frameworks.  Acknowledging past wrongs, tearing down statues of slavers and seeking forgiveness cannot undo the crimes.  However, they can sometimes help free the present — and future — from the shackles of the past. But, past wrongs must not distract us from present evils.  Outside of Africa, people of African descent are often among the last in line for health care, education, justice and opportunities of all kinds.
